Reference is made to that certain real property situated in t�e City of Redwood City, <br /> Couniy of San Mateo, Statie af California, commonl� referred to as 2580 El Ca�ino Real and described <br /> on E�ibit "A", attacl�ed hereto and incozporated by this reference as if f�zlly set forth herein (fhe <br /> "Property"). Tha Praperty is being develaped as a condominium projeot, although it is expected that the <br /> P�•operty will be oparated as a for-rent apartment community for the foreseeable future. If the Prope��ty is <br /> later sold as a condominium project then the interest ir�the Property will be transferred to a to-be�formed <br /> homeawner's association ("HOA"), a Califarnia nonprafit mutual l�enefit carporation, which HOA shall <br /> be u�tirna��ly responsible for the management,operafion and gover�ance of the Property. <br /> B. In connection with its development of the Propatty as a residential communify, the <br /> Developer submitted to the City Constrt►ction Improvement Plans, which incl�zde, inter alia, landsaaping <br /> plans for aiong the Propet�ty frontage ("Plans"), al� af which Plans ha�+e been approved by the City. The <br /> Plans provide for installation of certain landscaping, pedestrian Iighting, irrigati�n piping and controller <br /> {"Impravements") within �l�at portion of the City right-of-way ("Maintenanee Area") as the <br /> Imp�•avements and Maintenance Area are m�ore specifically shor�vn on.E�ibit"B" attached hereto and by <br /> this reference made a part her�of. <br /> C. The Developer has submitted a #inal map for th.e Property, which has been�•eviewed by <br /> the City Engineer and is being approved cancurrently witl�this Agreement("Fit�al Map"). <br /> D.
