Third Partv BeneficiarX. The City is intended to be a third party beneficiary of <br /> this Declaration, with the right, acting through the City Manager, to consent to any Amendment <br /> hereof to the extent above provided and the right and authority, at its sole option, to enforce the <br /> provisions hereo£ As a third party beneficiary of this Declaration, the City may bring legal <br /> action to compel performance of this Declaration and, if legal action is brought by the City, <br /> Declarant shall pay all of the costs of suit, reasonable attorney fees, arbitration costs and such <br /> other costs as may be determined by the court or arbitrator. <br /> ARTICLE 3 <br /> MISCELLANEOUS PROVISIONS <br /> 3.1. Notices. Any notice, offer, or communication required or permitted to be given <br /> by any provision of this Declaration shall be deemed to have been sufficiently given or served <br /> for all purposes if sent by registered or certified mail (return receipt requested), postage and <br /> charges prepaid, or by Federal Express or other reputable overnight delivery service requiring a <br /> signature upon receipt.
