6.1.J. - Page 50 <br /> 3.3. Severabilitv. If any term, provision, covenant or condition of this Declaration is <br /> held to be invalid, void or otherwise unenforceable, to any extent, by any court of competent <br /> jurisdiction, the remainder of this Declaration shall not be affected thereby, and each term, <br /> provision and covenant shall be valid and enforceable to the fullest extent permitted by law. <br /> 3.4. Breach Shall Not Permit Termination. It is expressly agreed that no breach of this <br /> Declaration shall entitle the Owner to cancel, rescind, or otherwise terminate this Declaration, <br /> but such limitation shall not affect in any manner any of the other rights or remedies that the <br /> Owner or City may have by reason of any breach of this Declaration. <br /> 3.5. Mort�a�ee Protection. No portion of this Declaration or any amendment or <br /> violation thereof shall operate to defeat or render invalid, in whole or in part, the rights of the <br /> beneficiary, insurer, guarantor, or holder of any mortgage or deed of trust encumbering the <br /> Property or any portion thereof; provided that, after foreclosure of any such mortgage or deed of <br /> trust, the property foreclosed shall remain subject to this Declaration. <br /> 3.6. California Law. This Declaration is being executed and delivered, is intended to <br /> be performed, in the State of California, and to the extent permitted by law, the execution, <br /> validity, construction and performance of this Declaration shall be construed and enforced in <br /> accordance with the laws of the State of California. <br /> 3.7. Terminolo�v. All personal pronouns used in this Declaration, whether used in the <br /> masculine, feminine, or neuter gender, shall include all other genders; the singular shall include <br /> the plural and vice versa. <br /> 3.8. Ca�tions. Article and section titles or captions contained herein are inserted as a <br /> matter of convenience and for reference, and in no way define, limit, extend, or describe the <br /> scope of this Declaration or any provisions hereof. <br /> 3.9. Not a Public Dedication. Nothing herein contained shall be deemed to be a gift or <br /> dedication of any portion of the Property to the general public or for the general public or for any <br /> public purpose whatsoever, it being the intention of the Owner hereto that this Declaration shall <br /> be strictly limited to and for the purposes herein expressed. <br /> 3.10. Duration. This Declaration and each term, easement, covenant, restriction and <br /> undertaking of this Declaration will remain in effect for a term of ninety-nine (99)years from the <br /> recordation date hereof and shall automatically be renewed unless the Owner elects not to so <br /> renew. <br /> 3.11. Runs with Land. All conditions, covenants and agreements contained herein shall <br /> operate as covenants running with the land.
