6.1.J. - Page 56 <br /> 27.Continuous site inspection shall be provided by a Soils Engineer to be <br /> approved by the City, at the applicant's sole expense, during trenching and <br /> backfill operations. The Soils Engineer shall take compaction tests, and <br /> shall submit test results to the City's Engineering department for approval. <br /> 28.The applicant shall ensure the installation of a new pedestrian crosswalk <br /> across EI Camino Real near the project site, and relocation of the Samtrans <br /> bus stop further north, subject to Caltrans approval (if necessary). <br /> 29.Where a Planned Development (PD) Permit has not been used within one <br /> (1) year from the date of granting, either by beginning of construction of the <br /> improvements or by the initiation of the activity which is the subject of the <br /> PD Permit, said Permit shall automatically terminate and be of no further <br /> effect. <br /> 30.Pursuant to Section 66474.9(b) of the California Government Code, the <br /> applicant shall defend, indemnify, and hold harmless the City, its agents, <br /> officers, and employees from any claim, action, or proceeding against the <br /> City or its agents, officers or employees, to attack, set aside, void, or annul <br /> an approval of the City, including but not limited to the Planning <br /> Commission, and the City's and Planning Commission's agents, officers or <br /> employees, concerning this subdivision, brought within the time period <br /> provided for in Section 66499.37. The City shall promptly notify the <br /> applicant of any such claim, action or proceeding and shall cooperate fully in <br /> the defense. <br />
