DES:dft !1/95 (007/12) <br /> <br /> reason of the Project, but by reason of the former <br /> use of the Property. While the generation thereof <br /> cannot be avoided, the diffusion and emanation <br /> thereof shall be controlled by collector, barrier <br /> and drainage systems as described in the 1988 <br /> FEIR, and do not pose a significant health hazard <br /> as concluded in the FSEIR. Safe levels of the <br /> diffusion of said gas shall be maintained by <br /> Westport through the installation of gas control <br /> and venting systems and, therefore, the effect of <br /> said gas, while significant, shall be mitigated to <br /> an acceptable level. Safe levels and disposal of <br /> leacheate have been, and shall be, maintained by <br /> the installation and maintenance of the final fill <br /> cover, impervious barriers, and drainage <br /> facilities, and, therefore, the effect of said <br /> leacheate, while significant, shall be mitigated <br /> to an acceptable level. The integrity of such <br /> mitigation shall be provided through monitoring <br /> programs supervised by regulatory agencies having <br /> jurisdiction over such matters. <br /> <br />i. In consideration of the foregoing findings, this <br /> Council hereby concludes and declares that the <br /> 1995 Development Agreement appropriately <br /> implements the 1994 Specific Plan and is <br /> consistent with the General Plan of the City of <br /> Redwood City and with the 1994 Specific'Plan. <br /> <br /> 12 <br /> <br /> <br />
