8.A. - Page 2 <br /> of the Settlement Agreement between McGowan Development, Friends of Cordilleras <br /> Creek and Finger Avenue Pride Committee (collectively "Friends") and the City of <br /> Redwood City. <br /> • On June 19, 2012, the Planning Commission held a public hearing, considered <br /> public input, recommended City Council certification of the Final EIR and, <br /> recommended that the City Council strongly consider approval of the EIR's <br /> environmentally superior project alternative described in the Draft EIR, pages <br /> 161-163. The alternative is entitled `Project Alternative with 25 Foot Creek <br /> Setback'. The Planning Commission also recommended the following: <br /> • That no additional increase in the size/ square footage of the residences on Lots <br /> 1-4 be allowed. <br /> • That no decrease in front yard setbacks for Lot 1-4 garages (driveway aprons) be <br /> allowed. <br /> • That no additional tree removals other than those (10 trees) already proposed for <br /> removal by the Project applicant be allowed. <br /> Such limitations would eliminate any unintended consequences that a project redesign <br /> might have on existing project site trees (i.e. the removal of a 37.9-inch Coastal <br /> Redwood (Tree #35)) and/or driveway apron parking. The Lot 1-4 residences would <br /> also be reduced in size/massing with implementation of the Planning Commission's <br /> recommendation. As such, staff proposes that these limitations be included as <br /> additional project conditions of approval as provided in Attachments 2 and 3. <br /> The Project applicant also agreed to an additional Condition of Approval to provide a <br /> public access easement over the Project's proposed private roadway. <br /> ANALYSIS <br /> Environmental Impact Report <br /> In their recommendation to certify the EIR, the Planning Commission determined that <br /> the EIR complies with the requirements of CEQA, is legally adequate and provides an <br /> accurate description of the environmental setting and analysis of the potential impacts <br /> of the Project and the various alternatives, and feasible mitigation measures, and <br /> recommended that the City Council certify it. <br /> David Powers and Associates, the City's environmental consultant, working with its sub- <br /> consultants, determined that no new impacts were identified by the letters and emails <br /> submitted before the Planning Commission hearing and, therefore, there is no need to <br /> revise and re-circulate the EIR. The comments do not introduce new information about <br /> a new significant impact or a substantial increase in severity of the impacts disclosed in <br /> the Draft and Final EIR. Refer to attached community emails and letters and David <br /> Powers and Associates summary response memo (Attachments 5 and 6). <br /> The EIR's certification would be based on the findings as set forth in Attachment 1.. <br />
