-73- <br /> 8.A. - Page 102 <br /> ATTACHMENT7 <br /> RESOLUTION NO. 72-16 <br /> A RESOLUTION QF THE PLANNING COMMISSION OF THE CITY OF <br /> REDWOOD CITY RECQMMENDlNG CITY COUNCIL CERTiFICAT�ON <br /> OF THE FINAL ENVIRONMENTAL IMPACT REPORT FOR THE <br /> FINGER AVENUE NINE-LOT PLANNED DEVELOPMENT PROJECT; <br /> ADOPTION OF CEQA FINDINGS, AND ADOPTION OF A MiTIGATiON <br /> MONITORlNG AND REPORTING PLAN, ALL IN ACCORDANCE WITH <br /> THE REQUIREMENTS OF THE CALIFORN�A ENVIRONMENTAL <br /> QUALITY ACT <br /> WHEREAS, McGowa� DevelopmErrt has applied for approval of a Planr�ed <br /> Development Permit and Vesting Tentative Map ta allow the demolition of the 1.69-acre <br /> project sife's existing structures (three primary single�family homes and three <br /> subordinate cottage-type dwelling units) and re-subdi�ision of the three existirtg parcels <br /> into nine lats to cons#ruct nine, two-story, singfe-famR�y residences with two car garages <br /> and fi�e guest paricing spaces. The Iots would range in size fram 6,000 to 8,214 square <br /> €eet. Portions of the F�omes on Lots 1- 4 would encroach with�n tf�e required 25-foot <br /> setbacfc area (per Zo�ing Ordinance Sec#ion 32.12 (F) (3}) with 15, 18 and 20 foot <br /> setbacks respecti�ely. The property would have an on-site storm drainage system. The <br /> applicant proposes to remove 10 trees (8 fiv�ng + 2 dead), reloca#e four trees on site <br /> a�d plant 52 replacement trees. Vehic�alar and pedestrian access to tf�e site wo�ld be <br /> via a 22-foot wide private one-way access road (the "Finger A�enue Project" or <br /> "Project"); and <br /> WHEREAS, the City has caused tF�e preparatian of a Final Env�ronmenta� Impact <br /> Report for the proposed F�nger Aven�e Project {tF�e "Final EIR"}, pursuanf to the <br /> requiremer�ts of the Californ�a Environmental Qual�#y Act (Public Resources Code <br /> Section 2�QQ0 et seq.; hereafter, "CEQA"), the Guidelines for Implementation of the <br /> Ca�ifornia Environmental Quafity Act (Title 14, Sections 15000 e� seq. of the Cal�fornia <br /> Code of Regtalatior�s; hereafter, the "CEQA Guidelines"'); and <br /> WHEREAS, on October 26, 20p9, Redwood City adopted a mitigated negati�e <br /> declaration (MND) �ursuant to the California Environmental Qualiiy Act (CEQA) and <br /> approved the Finger A�enue Project; and <br /> WHEREAS on No�ember 10, 2009, Friends of Cordilleras Creek and Finger <br /> Avenue Pride Commtttee (collecti�ely "Friends"} fifed a lawsuit with the San Mateo <br /> County S�perior Court seeking fo set aside the City's adoption of the MND and <br /> approvals of the Finger Avenue Project, alleging in the lawsuit rriolations of CEQA; and <br /> A7TY/fiES0.2253/AT7ACHMENT 1 FlIVGER CERT1FYfNG FIf�AL EIR-PC <br /> REV:106-'l4-12 VR <br /> �age 1 of 23 <br />
