-i4- <br /> 8.A. - Page 103 <br /> WHEREAS, on Ju�y 2fi, 20'�0, the City of Redwood City, McGowan Deve�opment <br /> and Frfends (the "�arties") entered into a Settlement Agreement, whereby the parties <br /> agreed that #he City would rescind aIf of the appro�als (Initial Study/MND, Planned <br /> Development Permit, and Vesting Tentative Map) related to the Fi�ger A�enue Project; <br /> and <br /> WHEREAS, the Parties also agreed to prepare an en�ironmental impact report <br /> (EfR) fo analyze the related environmental impacts associated with the Finger Avenue <br /> Praject; and <br /> WHEREAS, the parties further agreed tF�at the 2008 Initial Study associated with the <br /> MND sufficier�tly e�aluat�d #he Praject's remaining paten#ial impac#s and so the EIR <br /> need nof eval�aate potentiaf impacts other than those listed above; and <br /> WHEREAS, the Settlement Agreement also stipulated the minimum range of project <br /> alternati�es to be considered in the envirar�menta! review for#he Project, designed to be <br /> potentially feasible and to meet most project obJec#i�es; and <br /> WHEREAS, from January 25, 2011 #hrougF� February 23, 2Q11 the City he�d a <br /> p�ablic re��ew period on the Notice of Prepara#ion (NOP) for the Finger Ar►e�ue Project <br /> EIR. The City mailed, published and posted on its website a NO P ta nofify responsible <br /> agencies o'f the State Office of Planning ar�d Research, ali parties to the Settiement <br /> Agreement and surrounding property owners that an EfR woufd be prepared tor the <br /> F�nger Project in accordance with the stipulated judgment of the Superior Court for the <br /> County of San Mateo; and <br /> WHEREAS, on July 22, 2411, City staff iss�ed a Notice of A�ailability to <br /> announce the Draft EIR's availability for public and fesponsible agency re►riew and <br /> input; and <br /> WHEREAS, the Draft Focused Environmentai Impact Report for the Finger <br /> Avenue None-�ot Planned Development Project ("Draft EIR"} was circufated for public <br /> re�iew arrd comment for 4� days beginning on July 22, 2011 and ending on September <br /> fi, 2Q11, and was filed with the State Qffice of Pianning & Research under S#ate <br /> Clearinghouse No. 2008�12100; and <br /> WHEREAS� on August 16, 201�, the Planning Commission held a duly noticed <br /> public #�earing and received public testimony on the Draft EIR.
