-57- <br /> ATTACHMENT 2 <br /> 8.A. - Page 146 <br /> RESOLUTION NO. 12-17 <br /> A RESOLUTION OF THE PLANNING COMMlSSION QF THE <br /> CITY OF REDWQQD CITY RECOMMENDING CITY COUNCEL <br /> APPROVAL OF A PLANNED DEVELOPMENT PERMIT <br /> PURSUANT TO THE CiTY OF REDWOOD CITY ZONING <br /> �RDINANCE <br /> WHEREAS, K�rk McGowan dba McGowan Development ("App�icant"} <br /> su�mitted applications to the City of Redwoad City {"City") for a Planned <br /> Devefopment Permit, including Modifications #o zoning district regulatior�s, and a <br /> Vesting Tentative Map including Exceptions to the Suhdi�ision Ordinance; and <br /> WHEREAS, the Planning Commission of the City of Redwood City <br /> ("Commission") is empowered by Article 46 (Planned Devetopment Permits) of <br /> the City of Redwood Ciiy Zoning Code #o act tapon applicatior�s far planned <br /> deve�opment permits within sing�e-family residential zoning districts; the <br /> Commission is also empowered by the Subdivision Map Act and the Redwood <br /> City Municipal Code to consider Vesting Tenta#ive Map Appfications; and <br /> WHEREAS, pursuant to a Settlement Agreemertt dated July 26, 2010 by <br /> and among Applicant, City, and the Friends of Cordilleras Creek and Finger <br /> Avenue Pride Committee ("Frier�ds"}, among other things, the City agreed to <br /> prepare and certify an Environmental Impact Report (EIR} for the Project <br /> �ursuant to California Environmental Quality Act {"CEQA") before it may approve <br /> the Project. The City afso agreed that the Project arrd ElR shaf! be considered by <br /> bo#h fhe Ci#y's P�anning Commissivn and Cify Co�ncil. <br /> WHEREAS, on June 19, 2Q12, tf�e P(anning Commission cor�sidered and <br /> recommended that the City Council certify the En�ironmental Impact Report for <br /> fhe Finger Avenue Nine-Lot Planr�ed Developmer�t Project ("EiR") prepared by <br /> the City in accordance with the requirements of CEQA and, based on the EIR, <br /> considered and recommended that the City Council adopt a Mitigation <br /> Monitoring and Reporting Pragram in compliance wifh a!I CEQA requirements, as <br /> part of the City's consideration of Planned Develapment Permit Application No. <br /> PD2008-06, and Vesting Tentative Map Application No. TM20Q8-08; and <br /> WHEREAS, on June 19, 2012, the Planning Commission conducted a <br /> duly noticed public hearing, in accordance with all applicable requirements of the <br /> State Plannir�g and Zoning Law and the Redwood City Zoning Ordina�ce, to <br /> consider Planned Development Permit Application No. PD2008-06 and Vesfing <br /> A77Y/RES0.2254/ATTAGkMENT 2 FINGER PLANNED DEVELOPMEN7—PC <br /> REV:06-14-72 VR <br /> Page 7 af 21 <br />
