-78- <br /> ar$ A. - Page 167 <br /> RESOLUTION NO. 92-7$ <br /> A RESOLUTION OF THE PLANNING COMMISSIQN OF THE <br /> CITY OF REDWOQD ClTY RECOMMENDlNG CITY COUNCIL <br /> APPROVAL OF A VESTlNG TENTATlVE MAP Pl1'RSUANT TQ <br /> THE SUBDIVISION MAP ACT AND THE REDWOOD ClTY <br /> MUNIClPAL CODE <br /> WHEREAS, Kirk McGowan dba McGowan Development ("ApplicanY'} <br /> submitted applications to the City of Redwood City ("City"} for a Planned <br /> Development Permit, including Modifications to zo�ing district regulations, and a <br /> Vestir�g Tentative Map including Exceptions to the Stabdi�ision Qrdinance; and <br /> WHEREAS, the Planr�ing Commission of the City of Redwood City <br /> ("Commission"} is empowered by Article 46 (Planned Development Permits} to <br /> act upan appfications for planned devefopment permits; the Commission is also <br /> empowered by the Subdi�ision Map Act and the Redwood City Municipal Code to <br /> consider Vesting Tentative Map Applications; and <br /> WHEREAS, pursuant to a Seftlement Agreement dated July 26, 20�0 by <br /> and among Appiicant, City, and the Friends af Cardilleras Creek and Finger <br /> Avenue Pride Committee ("Friends") , among ofher things, the City agreed to <br /> p�epare and certify an Environmental Impact Report (EIR) for the Project <br /> pursuant to California Er�vironmer�ta! Quality Act ("CEQA"} before it may appro�e <br /> the Project. The City also agreed that the Project and EIR woufd be considered <br /> by both the City's Planning Commission and City Council; and <br /> WHEREAS, on June 19, 2012, the PlanRing CommissFOn considered and <br /> recommended tf�at the City Cotanci! certify an Environmen#al Impact Report for <br /> the Finger Avenue Nine-Lat Planned De�elopment Project ("EIR"} prepared by <br /> the City ir� accordance wi#h the requirements of CEQA and, based on the EIR, <br /> considered and recommended that the City Council adopt a Mitigation Monitoring <br /> a�d Reporting Program in compliance with all CEQA requirements, as part of the <br /> City's consideratiorr of Planned Developme�t Permit Application No. PD2008-Ofi <br /> and Ves�ing Tentati�e Map Application No. TM2008-08; and <br /> WHEREAS, on June 19, 20�2, the Pianning Commission conducted a <br /> duly noticed public hearing, in accordance with all ap�licable requirements of the <br /> State Planning and Zoning Law and the Redwood City Zon ing Qrdinance, to <br /> consider Planned De�elopmen� Permit Applicatior� No. PD2008-06 and Vesting <br /> ATTY/RES0.22551ATTACHMENT 1 FINGER VESTING TENTATNE MAP-PC <br /> REV;Ofi-14-12 VR <br /> Page 7 of 18 <br />
