I am informed by my client that Ms. Ekas <br />told him to have his attorney speak to the City Attorney. Thereafter, I was contacted and <br />tried unsuccessfully to speak with the City attorney, leaving a voice mail message in <br />early May, 2003 and later speaking with leis. Ekas on May 19, 2002 who told me then to <br />have the matter put on the City Council agenda. On May 20, 2003, I spoke with you, <br />who told me only the City Council could deal with the EIR requirement. <br />At this time I am requesting that the issue of the EIR requirement for the single lot <br />development of the Property be placed on the City Council agenda. <br />My client contends that this EIR requirement violates state law and is being <br />unjustly applied to his lot which contrary to the attached letter is not substandard, has <br />readily available utilities, and does not have unstable soil. <br />It does have a heritage tree which my client's plans call for to be protected. <br />
