Pui�rose, The purpose of this Agreement is to guarantee completion of the finprovements <br /> and ensure satisfactary performance by Developer of Developar's obligations to sansfy the Conditions <br /> pertaining to the Improvements, <br /> 2. Propei�Subject to A�reement. The Proparty shall be subject to#his Agreement <br /> 3. Dutv to Install Improvements, Developer v✓ill construct,insta.11 and complete,or cause to <br /> be consiructed, installed and completed, at the Developer's sole cost and expense, the Improvements, in <br /> accordance with the Improvement Plans (defined in Recital E. above) and to the satisfaction of the City <br /> Engineer, in his reasonable discretion.
