Comple�ion Date. Developar will cono�.plete the Work within two years of the Effective <br /> Dafie. All Work will be campleted in a good and workmanlike mannar in accordance with accepfed <br /> deszgn and construction practices and consistent�t�vif.h the�nprovement Plans. This comple�ion date may <br /> be extended by City in its sole and absoiute diseretion at the xequesf of Daveloper,which request shall be <br /> accompanied by a written assurance acceptabla to the City Engineer that the secuxxtzes required by <br /> Section 13 sha11 remain enforceable throughout the term of the extension. <br /> 5. Estimated Cost of Work, The engineer's estimated cost of the Work is roughly Six <br /> Hundred Eighiy Nine Thousand Three Hundred Sixty Dollars($689,360.00)(`Bstimated Cost of Work"}. <br /> 6. Modifica�ions to the Plans. Approval of this Agreement by City does not release <br /> Davalopar of its responsibility to correct mistakes,errors ar omissions in the Improvement Plans. If, at <br /> any time, in the opinion of the City Engineer, in his raasonable diseretion, the I'mprovement Plans are <br /> deemed inadequate in any xespect,Developer agrees to make such modi�cafions,changes or revisions as <br /> necessary in order to cornplete the Work in a good and workmanlike manner in accordance witlz aaeepted � <br /> design and canstruciaon standards and consistant with the Conditions and Irnprovement Plans. <br /> 7. Repaixs. Developsr agrees to repair or Iiave repa.ired in a timely manner at its sole cost <br /> and expense all public roads,stxeets, or other public or private properly damaged as a result of the Work <br /> or in connection with the development of#ha Property, or to pay to the property owner of any damaged <br /> road, sireet or property the f�ll cost of such repair. In addition, Developer shall obtain the written <br /> acceptance of such repair or payment from any owner whose private or public properly was repaired by <br /> Developer or f.o whom Developer has paid tha full cost af such repair in accordance with this Section 7. <br /> City shall be under no obliga.tion whatsoevar to accept the Work completed under this Agreement until <br /> such time as alI xepairs have been completed or have been paid for and writtan acceptances have been <br /> pro�ided to the City Bngineer. <br /> 8. Foreman or Superintenden� Developer shall give personal attention to the Woxk. A <br /> eompetent foreman or superintandent, satisfactory to the City Enginaer in his reasonable discretion with <br /> . authority to xepresent the Developer,shall ba named in writing by Developer prior to commencemsnt of <br /> the Work, shall be present on the Property duxing the performance of tl�.e Work and may not be changed <br /> without advance notifica#ion to the City Engineer. <br /> 9. E7camination o£Work. All of tha Work sha11 be consistent with the Improvement Plans <br /> and per.foxmed to the satisfact�on of the City Engineer, in his reasonable discretion. City and ifs <br /> authorized agents sha11,at all times during the performance o£tb.e Work,ha�e free access to the Property <br /> and the Work and shati be allowed.to examina the Worlc and all raaterials usecl and to be used in the <br /> Work. <br /> 10, City Costs; Deposit. Developer sha11 pay to City the actual oosfi fox alI engineering, <br /> inspection, administration, pIan check, laboratory and field fiesting, construction, an.d other services <br /> fumished by City in connection with fihis Agreement, including those perFormed by coz�sulfa.nts under <br /> contract witth Czty ("City Costs"}. Developar shall depasit with City the suna of Tlurty Thousand and <br /> Nol100 Dollars($30,044.00}("Deposz�')to compansate Cify for all City Costs.
