r � <br /> 6) Any and all changes to the contract or the specification will be documented on MCM's <br /> standard DCR. All changes will require City or its representative's authorized signature <br /> prior to work commencing. Changes that require fixed cost estimates in advance of <br /> approval by City, will permit the builder to charge for his time and material in establishing <br /> the fixed cost estimate, as many estimates will require some engineering or engineering <br /> considerations. If a DCR amends the delivery schedule, this change will be presented by <br /> MCM on the DCR estimate and require the approval by City. <br /> 7) Any delays caused by City or its representative(s) or by delays in equipment specified by <br /> City by a new DCR are not the responsibility of MCM, provided however, delays in <br /> equipment listed herein as part of this original contract are the responsibility of MCM. All <br /> written questions requiring advice from City, related to the project require a written <br /> response within five (5) business days to prevent any potential delay. Fax numbers for questions are MCM 613- <br /> 542-6515, Redwood City Fire Department 650-780-7461, E-mail addresses for questions <br /> are; MCM, (ian.d@metalcraftmarine.com) Redwood City Fire Department, <br /> (mschutt@redwoodcity.org) MCM is responsible for timely placement of Purchase Orders <br /> relating to the equipment specified. <br /> 8) During the entire time of this contract while construction of the vessel is ongoing, MCM <br /> shall maintain a comprehensive Ship Builder's Risk insurance policy covering all aspects <br /> of the vessel, from commencement to completion of construction. Such insurance shall be <br /> sufficient for full replacement of the vessel and shall cover all damages. MCM's insurer is <br /> Stevenson&Hunt Marine Division, of London Ontario. MCM shall also provide shipping <br /> insurance which shall cover all aspects of loss and liability not covered by the licensed <br /> carriers of the vessel, including both trucking and transport by ship. The Ship Builder's <br /> Risk policy ends when the boat has been loaded upon its conveyance which meets the <br /> requirement of FOB, (Free On Board), at which point MCM shall insure that the shipping <br /> insurance covers the vessel, from time of departure from the MCM yards to signed receipt <br /> by City at the Redwood City port. MCM shall also obtain shall and maintain for the <br /> duration of this agreement and any and all amendments, insurance against claims for <br /> injuries to persons or damage to property which may arise out of or in connection with <br /> performance of the work by MCM or MCM's agents, representatives, employees or <br /> subcontractors, General commercial Liability insurance, with a limit of$5,000,000 <br /> combined single-limit per occurrence for bodily injury, personal injury and property <br /> damage. If the submitted policies contain aggregate limits, general aggregate limits will <br /> apply separately to the work under this agreement or the general aggregate will be twice the <br /> required per occurrence limit. MCM shall maintain this insurance until after the vessel has <br /> been delivered, MCM has completed all training of City's personnel on the vessel and the <br /> vessel has been fully and finally accepted by City. <br /> The full cost of all insurance, including but not limited to, builder's Risk, shipping <br /> insurance and commercial liability insurance shall be paid for by MCM. MCM shall insure <br /> that City is named an additional insured on all required insurance policies. Prior to City's <br /> execution of this agreement, MCM will furnish certificates of insurance and endorsements <br /> Page 2 of 4 <br />
