The Property Owner recognizes that the stormwater treatment measure(s) <br /> more particularly described and shown on Si#e Plan, of which full-scale plans and any <br /> amendments thereto are on file with the Engineering & Construcfion Services of the City of <br /> Redwood City must be installed and maintained as indicated in this Agreement and as <br /> required by the NPDES Permit; and <br /> H. The City and Property Owner agree that the health, safety and welfare of the <br /> citizens of the City require fihat the stormwater treatment measure(s) detailsd in the Site <br /> Plan or camparable document be constructed and maintained on the Property;and <br /> I. The City's Stormwater Managemen# Ordinance, guidelines, criter�a and other <br /> written directions require that the stormwater treafinent measure(s), as shown an the <br /> approved Site Plan or comparable document, be construc#ed and main�ained by the <br /> Praper#y Owner. <br /> AGREENIENT <br /> NOW, THEREFORE, in consideratian of the benefit received by the Property Owner <br /> as a result of the Ciiy's approva{ of the Site Plan, the Property 4wner hereby covenants <br /> and agrees with the City as follaws: <br /> 1. Constructiort of Trea#ment Measures. The on-site stormwater treatment <br /> measure{s) shown on the Site Plan document shail be cons#ructed by the Property�wner <br /> in conformance with the approved plans and specifications identified for the development <br /> and any other requirements thereto which have been approved by the City in conformance <br /> with appropriate City ordinances, guidelines, criteria and other written direction. <br /> 2. Operation & Maintenance Resqonsibility. This Agreement shall serve as the <br /> signed statement by the Property Owner accepfing responsibility for operation and <br /> maintenance of sformwater treatment measures as set forth in this Agreement until the <br /> responsibility is legally transferred to another person or enfity. Before #he Property is <br /> legally trartsferred to anofher person or entity, the Property Owner shall provide to the <br /> • � City at feast one of the fol[owing: <br /> a. Written conditions in the sales agreement requiring the buyer to assume <br /> responsibility for operation and maintenance (O&M) consistent wi#h this pravision, which <br /> conditions, in the case of �urchase and sale agreements, shall be written to survive <br /> beyond tha close of escrow; or <br /> b. Written text in project conditions, covenants and restrictions (CC&Rs) far <br /> residential properties assigning O&M responsibilities to the home owners association for <br /> �&M of the treafinent measures; or <br /> c. Any ather legally enforceable agreement or mechanism that assigns <br /> respansibility for the maintenance of treatment measures. <br /> 3. Maintenance of Treatment Measures. The Property Owner shall not destroy or <br /> remove the stormwater treatment measures from the Praperly nor modify the sfarmwater <br /> treatment system in a manner that lessens its effectiveness, and shafl, at Property <br /> Owner's sale expense, adequate[y maintain the starmwa#er treatment measure(s) in <br /> good working order acceptable to the City and in accordance with the Site Plan.
