i
7 TAT`DAC pUBLIC HEARING *(Agenda was revised 06/04/2010 to correct
subheading)
A. Appeal of an Initial Study/Negative Declaration for a Zoning Text Amendment
pertaining to lot size regulations for the Residential Duplex (R-2) Zoning
District in Article 6 of the Zoning Ordinance. (603) (301)
Recommendation:
1. Deny the appeal by motion, and thereby uphold adoption by the Planning
Commission of the Initial Study/Negative Declaration (IS/ND) regarding the
R-2 Zoning Text Amendment, as revised (Attachment 1), with the following
finding:
On the basis of the entire record before the City Council, including the Initial
Study, any comments received, and the testimony and evidence presented
at the June 7, 2010 public hearing, that there is no substantial evidence that
the project will have a significant effect on the environment, and that the
IS/ND reflects the lead agency's independent judgment and analysis.
2. Introduce an Ordinance amending Article 6 of the Zoning Ordinance for the
R-2 Zoning District (Attachment 2) pursuant to the Planning Commission's
recommendation.
AN ORDINANCE AMENDING ARTICLE VI R-2 (RESIDENTIAL DUPLEX) ZONING
DISTRICT OF THE REDWOOD CITY ZONING ORDINANCE
Saleish Mehra, Associate Planner, presented the report (presentation on file). He
explained that the ordinance does not specify rules for increments above 10,000 square
feet. He also shared past practices focusing on a few of the Planned Permits issued.
He explained that staff recommends that Council deny the appeal and accept the other
actions in the staff recommendation. Ms. Ekas, Planning, Housing & Economic
Development Director, provided some context for this zoning text amendment as well
as next steps. She also covered the community outreach done in preparation of the
hearing tonight and how it exceeded the legal requirements. She then covered next
steps. She also covered the Planning Commission assessment.
Mayor Ira explained that this item had to be moved from last week due to a newspaper
snafu. He then opened the Public Hearing.
Mr. Bautista expressed his disappointment at the process. He said he was notified
about the public hearing 10 days in advance and he is upset about the fact that the staff
report does not mention his appeal. He believes that this zoning text amendment will
allow apartments in R-2 zoning. He was extremely upset about a certain attachment of
the staff report. He also opined that this is tied to the Kentfield project and its density.
Mr. Bautista said there will probably be a lawsuit since this is an extension of the
JOINT CITY COUNCIL/REDEVELOPMENT AGENCY BOARD June 7, 2010
MEETING MINUTES PAGE 2
MINUTE BOOK NO. 63
Page No. 100
