Motion carried 4-0 by roll call vote <br /> with three Council Members absent (Ira, Aguirre, Foust). <br /> Chair Pierce stated since there are less than 12 persons registered to vote within the <br /> territory of the proposed District, the vote shall be by the landowners of the proposed <br /> District Formation. Each landowner has therefore submitted an executed Consent and <br /> Waiver, waiving the noticing and election requirements in connection with the Act. <br /> Chair Pierce asked: "Have 100% of the Consent and Waivers been received by the City <br /> Clerk, so that we may hold the Community Facility District Special Election today?" City <br /> Clerk Vonderlinden answered: "yes, I concur with holding the election today." Chair <br /> Pierce announced because a majority protest does not exist, it is appropriate for the <br /> City Council to consider resolutions to form the District, to declare the necessity to incur <br /> bonded indebtedness within the District, and to call a special election within the District. <br /> Recommendation: <br /> 1. Approve by resolution, Formation of City of Redwood City Community <br /> Facilities District No. 2010-1 (One Marina), Authorization for the Levy of a <br /> Special Tax within the District, Setting of Preliminary Appropriations Limit for <br /> the District, and Submitting of Levy of the Special Tax and the Establishment <br /> of the Appropriations Limit to the Qualified Electors of the District. <br /> Resolution No. 2010-15052 <br /> RESOLUTION NO. 15052 OF FORMATION OF CITY OF REDWOOD CITY <br /> COMMUNITY FACILITIES DISTRICT NO. 2010-1 (ONE MARINA), AUTHORIZING <br /> THE LEVY OF A SPECIAL TAX WITHIN THE DISTRICT, PRELIMINARILY <br /> ESTABLISHING AN APPROPRIATIONS LIMIT FOR THE DISTRICT AND <br /> SUBMITTING LEVY OF THE SPECIAL TAX AND THE ESTABLISHMENT OF THE <br /> APPROPRIATIONS LIMIT TO THE QUALIFIED ELECTORS OF THE DISTRICT <br /> M/S Bain/Seybert to approve the formation of the District. Motion carried 4-0 by roll <br /> call vote with Council Members Ira, Aguirre and Foust absent. <br /> Resolution No. 2010- 15053 <br /> RESOLUTION No. 15053 DETERMINING THE NECESSITY TO INCUR BONDED <br /> INDEBTEDNESS WITHIN CITY OF REDWOOD CITY COMMUNITY FACILITIES <br /> DISTRICT NO. 2010-1 (ONE MARINA) AND SUBMITTING PROPOSITION TO THE <br /> QUALIFIED ELECTORS OF THE DISTRICT <br /> M/S Seybert/Bain to incur bonded indebtedness within the Community Facilities District <br /> No. 2001-One Marina.
