2. SERVICES OP CITY. <br /> a. Pay contractor the sum of Two Thousand Five Hundred Dollars (f2,500.00) <br /> to be used for funding of performances of The Nutcracker at the Fox Theater in <br /> December 2012. <br /> 3. It is understood and agreed that this agreement is for the performance of expert <br /> professfonal services and that in the performance thereof you shali be deemed <br /> an independent contractor, and not an employee, agent or other representative <br /> of the City. Services to be performed hereunder shall be deemed unique <br /> organizational services, and you shall not assign, sublet, transfer or otherwise <br /> substitute your interest in this agreement or your obligations hereunder, without <br /> the prior written consent of the City. <br /> 4. Contractor acknowledges and agrees that it shall bear ali costs of the program <br /> described in this agreement which exceed the amount provided by the City of <br /> Redwood City as described in paragraph 2a. <br /> If the foregoing terms and conditions are acceptable to the Contractor, and the <br /> Contractor desires to contract for the funds herein described, kindly have the original <br /> thereof executed and return the same to the City.
