be relocated southerly pursuant to an agreement between RMC Lonestar and Pacific Shores, <br /> including those easement rights to be granted to City by Pacific Shores necessary for City <br /> ownership and operation of such line, all to be owned by City. <br /> Vesting Tentative Map. The Vesting Tentative Map TM-10806-7, approved by the <br /> Planning Commission of City on July 21, 1998. E�ibit F is a copy of the Vesting Tentative <br /> Map, which shall have a duration equal to the maximum duration provided by Section <br /> 66452.6 of the Subdivision Map Act or the term of this Agreement, whichever is longer. <br /> Water and Sewer Facilities. All those facilities on the Project Site, including those <br /> installed in the Private Loop Road for the supply and distribution of domestic water service <br /> (including firefighting uses) and those pump stations and force mains from them to the <br /> Seaport Boulevard Improvements and Other City Facilities for the collection, treatment and <br /> disposal of sanitary wastes, all of which shall be owned and maintained by the City. Water <br /> and Sewer Facilities do not include individual water lines within and serving individual <br /> Parcels and do not include irrigation wells or lines emanating from such wells to individual <br /> Parcels. <br /> Waterfront Park. That portion of the Project open space parallel to and along <br /> Westpoint Slough dedicated to open space and recreational uses, which may include limited <br /> buildings and facilities such as but not limited to a marine resource center, an aqua.tic center, <br /> a boat dock, a conference facility, cafe/restaurant, a retreat center and various paths, trails and <br /> similar facilities, comprising that Common Parcel designated as lot D and those Accessory <br /> Building Parcels designated as lots 13, 14, 15 and 16, as shown on Exhibit B-1. <br /> 3. Term. <br /> (a) All rights and obligations of the City and Pacific Shores hereunder shall <br /> commence upon the Effective Date and shall continue in full force and effect until this <br /> Agreement terminates as provided herein. <br /> (b) The City may ternunate this Agreement under the following <br /> circumstances: <br /> (i) If a Final Development Plan for at least one Building Pazcel has not <br /> been submitted for approval within one year after the Effective Date; or <br /> (ii) If construction has not commenced (involving the driving of all piles <br /> and pouring of the foundation slab necessary for the building) on at least 350,000 <br /> square feet of GBFA within five years after the Effective Date; or <br /> (iii) If construction has not commenced on at least 750,000 square feet of <br /> GBFA prior to ten years after the Effective Date; or <br /> (iv) If annexation has not occurred within one year of the Effective Date. <br /> K:\DOC\0002\0033\AGR\CI1'Y.DA6 �0 29-�ec-199B AT 15:00 <br />
