6.1.C. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> September 10, 2012 <br /> SUBJECT <br /> Approval of Right of Entry Agreement between Redwood City and Harbor Village, LLC <br /> RECOMMENDATION <br /> By motion, approve and authorize the City Manager to execute the Agreement for Right <br /> of Entry between Redwood City and Harbor Village, LLC. <br /> BACKGROUND <br /> Redwood City has over 10 miles of creeks, drain ditches, and canals within the City's <br /> boundary. Those are key channels to move storm water runoff from the City to the Bay. <br /> Annual cleaning and maintenance during the summer months are the best management <br /> practices to assure proper flow of storm water runoff during the rainy season. <br /> The Bayfront Canal is one of the City's unlined channels that requires annual cleaning. <br /> To maintain the channel the City must gain access through the Harbor Village property, <br /> located at 3015 East Bayshore Road. <br /> ANALYSIS <br /> City staff and the owner of the Harbor Village property negotiated a "Right of Entry" <br /> agreement for performing the channel cleaning work. Although the City has easement <br /> rights to access its Fifth Avenue pump station located in the mobile home park, it did not <br /> have adequate access from the land side to the storm pipe outfalls in the channel. <br /> Consequently, reeds and other obstructions precluded the outfall flap-gates from <br /> functioning properly. In large storms and with high tides, the failure of the gates to <br /> function properly can exacerbate the upstream flooding conditions. <br /> The Agreement provides the City rights of access to maintain the canal properly and <br /> regularly up to ten times each year. Once a year, with ten days notice, the City and the <br /> property owner will meet to determine maintenance needs. City crews will provide three <br /> days advance notice to the operators of the mobile home park so that tenants who <br /> might be affected by the City's efforts can be prepared. Upon approval by the City <br /> Council, the Public Works Services division will schedule its initial cleaning and clearing <br /> effort as part of the citywide storm season preparation. <br />
