Re-open the Public Hearing; 2. Adopt Resolutions a. Certifying the Environmental Impact Report (Attachment 1) b. Approving the Planned Development Permit (Attachment 2) c. Approving the Vesting Tentative Map (Attachment 3) BACKGROUND At its meeting of July 9, 2012, the Council reviewed the Planning Commission's recommendation to certify the EIR and approve the proposed 9-lot subdivision on Finger Avenue. Specifically, the Planning Commission recommended that the City Council certify the Final EIR and approve the EIR's environmentally superior project alternative entitled "Project Alternative with 25 Foot Creek Setback." The Planning Commission's recommendation also included the following: • That no additional increase in the size/ square footage of the residences on Lots 1-4 be allowed. • That no decrease in front yard setbacks for Lot 1-4 garages (driveway aprons) be allowed. • That no additional tree removals other than those (10 trees) already proposed for removal by the Project applicant be allowed. The July 9, 2012, report to Council is also attached to this report to provide a complete description of the project and the process to date. In light of the history of the project and ongoing concerns raised by the Finger Avenue Pride Committee (FAPC) and the Friends of Cordilleras Creek (FCC), Council directed the developer and the concerned groups to try to work with the City Manager and Community Development Director to find an equitable solution. Staff recommended that a third-party facilitator be considered.
