Re-open the Public Hearing; <br /> 2. Adopt Resolutions <br /> a. Certifying the Environmental Impact Report (Attachment 1) <br /> b. Approving the Planned Development Permit (Attachment 2) <br /> c. Approving the Vesting Tentative Map (Attachment 3) <br /> BACKGROUND <br /> At its meeting of July 9, 2012, the Council reviewed the Planning Commission's <br /> recommendation to certify the EIR and approve the proposed 9-lot subdivision on <br /> Finger Avenue. Specifically, the Planning Commission recommended that the City <br /> Council certify the Final EIR and approve the EIR's environmentally superior project <br /> alternative entitled "Project Alternative with 25 Foot Creek Setback." The Planning <br /> Commission's recommendation also included the following: <br /> • That no additional increase in the size/ square footage of the residences on Lots <br /> 1-4 be allowed. <br /> • That no decrease in front yard setbacks for Lot 1-4 garages (driveway aprons) be <br /> allowed. <br /> • That no additional tree removals other than those (10 trees) already proposed for <br /> removal by the Project applicant be allowed. <br /> The July 9, 2012, report to Council is also attached to this report to provide a complete <br /> description of the project and the process to date. <br /> In light of the history of the project and ongoing concerns raised by the Finger Avenue <br /> Pride Committee (FAPC) and the Friends of Cordilleras Creek (FCC), Council directed <br /> the developer and the concerned groups to try to work with the City Manager and <br /> Community Development Director to find an equitable solution. Staff recommended that <br /> a third-party facilitator be considered. <br />
