8.A. - Page 2 <br /> ANALYSIS <br /> Subsequent to the City Council meeting, staff contacted both sides and suggested using <br /> Kip Harkness as the facilitator. Mr. Harkness has worked closely with the City Council <br /> to develop consensus on issues previously. Both sides agreed to use Mr. Harkness for <br /> this facilitated discussion. Two working sessions were held between the neighborhood <br /> and the developer, one on August 1, the other on August 23. <br /> First Facilitated Discussion <br /> Prior to the first session, Mr. Harkness and the Community Development Director met <br /> on-site with Kirk McGowan, the project developer and in a separate meeting with Julie <br /> Abraham and Dan Ponti of FAPC and Richard Izmirian of FCC. The same three <br /> neighborhood representatives participated in the facilitated discussion; the developer's <br /> interests were represented by Kirk McGowan and Patrick Geary. <br /> The first session lasted seven hours and did not end with a compromise subdivision <br /> agreement or plan. Each party's positions are listed below: <br /> Neiqhborhood Position <br /> 1. The 25' setback from the top of creek bank, as recommended by the Planning <br /> Commission is an absolute. <br /> 2. The houses on lots 7 & 8, which front on Finger Avenue, to be set back from <br /> Finger Avenue 20' (approximately the distance of Mr. Ponti's house from Finger <br /> Avenue), and have a building frontage of approximately the same as Mr. Ponti's <br /> in relation to the overall width of the lot's frontage. <br /> 3. Only one point of ingress/egress from Finger Avenue. <br /> 4. Lot 6 (which is immediately behind Mr. Ponti's property) is removed from the <br /> development. <br /> 5. If, as a result of numbers 3 and 4, above, there is residual property, it could be <br /> sold to Mr. Ponti for fair market value. <br /> Developer Position <br /> 1. The houses on lots 3 & 4 can be moved beyond 25' from the top of bank. Lots 1 <br /> & 2 cannot. (Lot 1 can be moved, theoretically, but it requires the removal of a <br /> 38" Redwood tree.) <br /> 2. The house on Lot 7 can be redesigned or moved to meet the requested 20' <br /> setback from Finger Avenue. The house on Lot 8 is already a single-story <br /> structure along Finger Avenue until at least 30' from Finger Avenue, so the effect <br /> of a setback adjustment already exists. <br /> 3. The loop road is more efficient and safer than the requested hammerhead, <br /> single-entry design. Consequently, not a desirable solution. <br />
