8.A. - Page 10 <br /> map, and all other documents, reports, studies, memoranda, maps, oral and written <br /> testimony, and materials in the City's file for the applications and the Project, and all <br /> adopted City planning documents relating to the Project and the property including the <br /> City's General Plan, Zoning Ordinance, and other applicable City laws and regulations, <br /> and all associated approved and certified environmental documents, have together <br /> served as an adequate and appropriate evidentiary basis for the findings and actions <br /> set forth in this Resolution. <br /> 2. The City of Redwood City is the lead agency under CEQA for preparing <br /> the Final EIR, and the City Council is the final decision-making authority with regard to <br /> approval of the Finger Avenue Project as defined in section 15356 of the CEQA <br /> Guidelines. <br /> 3. The City Council finds that the Final EIR for the Project was presented to <br /> the City Council, that the Final EIR was prepared, published, circulated, reviewed and <br /> completed in full compliance with State law and CEQA Guidelines, that there was <br /> adequate public review of the Draft EIR, that it has considered all comments on the <br /> Draft EIR and responses to comments, that the Final EIR adequately discusses all <br /> significant environmental issues, and that the Final EIR reflects the independent <br /> judgment and analysis of the City Council. <br /> 4. The City Council has reviewed and considered the information contained <br /> in the Final EIR prior to taking action on the proposed Finger Avenue Project. <br /> 5. The information added in the Final EIR does not constitute significant new <br /> information requiring recirculation of the Draft EIR, but rather that additional information <br /> clarifies or amplifies an already adequate EIR. <br /> 6. Pursuant to CEQA section 21081 and CEQA Guidelines section 15091, <br /> and in support of its approval of the Project, the City Council has reviewed and <br /> considered the CEQA Findings of Fact for the Project, attached hereto as Exhibit A and <br /> incorporated herein by reference, and hereby adopts the attached CEQA Findings of <br /> Fact. <br /> 7. Pursuant to California Public Resources Code section 21081 and the <br /> CEQA Guidelines section 15091(a)(1), the City Council hereby finds that changes or <br /> alterations have been required in, or incorporated into, the Project which avoid or <br /> substantially lessen the Project's potentially significant environmental effects as <br /> identified in the Final EIR, such that the Project, as approved, will not have any <br /> significant environmental effects. <br /> 8. Pursuant to CEQA section 21081.6 and CEQA Guidelines sections <br /> 15091(d) and 15097, and in support of its approval of the Project, the City Council <br /> hereby adopts the Mitigation Monitoring and Reporting Program attached hereto as <br /> Exhibit B and incorporated herein by reference, to require all mitigation measures <br /> described in the Final EIR be implemented by means of Project conditions, agreements, <br /> or other measures. <br /> ATTY/RES0.2783/CC FINGER RESO CERTIFYING FINAL EIR <br /> REV:08-31-12 VR <br /> Page 4 of 42 <br />
