8.A. - Page 84 <br /> ATTACHMENT3 <br /> (i) The applicant accepts responsibility for the adequate installation/ <br /> construction, operation, maintenance, inspection, and reporting of <br /> any on-site stormwater treatment measures being incorporated into <br /> the Project until the responsibility is legally transferred to another <br /> entity; and <br /> (ii) The applicant provides and ensures legal access to the on-site <br /> stormwater treatment measures for representatives of the City, the <br /> local vector control district, and staff of the Regional Water Quality <br /> Control Board, San Francisco Region, for the purpose of verifying <br /> the implementation, operation, and maintenance of the on-site <br /> stormwater treatment measures and taking corrective action if <br /> necessary. The agreement shall be reviewed and approved by the <br /> City prior to recordation and recorded at the County Recorder's <br /> Office at the applicant's expense. <br /> 38.Applicant shall submit an Erosion and Sediment Control Plan to the City <br /> Engineer for review and approval prior to commencing any work on the <br /> Project, including demolition or grading work. The Plan shall show Best <br /> Management Practices (BMPs) for storm water pollution prevention. <br /> Additionally, the plan shall include specific provisions for the protection of the <br /> creek from erosion, sediment, and construction debris. All construction work <br /> in connection with this Project must conform to the approved Erosion and <br /> Sediment Control Plan. <br /> 39. Prior to commencing any work on the Project, including demolition or grading <br /> work, the applicant shall post at all entries to the Project site in clear view of <br /> the public right-of-way, a sign as required by RCMC Section 24.33 indicating <br /> the hours of construction and limitations on construction noise. Additionally, <br /> the sign shall include a phone number of the applicant's designated contact <br /> for complaints about problems with the construction activity. <br /> 40.Applicant shall be responsible for the cost of repairs to any improvements <br /> within the public right-of-way that are damaged during construction. The <br /> applicant shall submit documentation of the existing condition of Finger <br /> Avenue from the westerly extent of the Project site to the intersection of <br /> Finger Avenue and EI Camino Real and the public improvements along the <br /> Project's frontage, including but not limited to trees, tree grates, signs, light <br /> poles, drainage inlets, curbs, gutters, etc. to the satisfaction of the City <br /> Engineer prior to issuance of a grading or building permit. This survey shall <br /> be submitted to the City Engineer for review and approval. All damage shall <br /> be repaired to the satisfaction of the City Engineer at no cost to the City prior <br /> to the release of subdivision securities.
