8.A. - Page 87 ATTACHMENT3 56.The Vesting Tentative Map shall expire twenty-four (24) months from the date the map was conditionally approved by the Planning Commission unless the Final Map has been recorded in accordance with Redwood City Municipal Code Section 30.45. As provided for in RCMC Section 30.66, the applicant may request an extension of the expiration date for this Tentative Map approval by filing a written application with the Planning Manager at least forty five (45) days before the conditional approval is due to expire. The application shall state the reasons for requesting the extension. In granting the extension, new conditions for approval of the tentative map may be imposed and existing conditions may be revised. Extensions shall not exceed a total of two (2) years. 57. In compliance with RCMC Section 30.89, upon completion of the construction of all improvements, the applicant shall amend the improvement plans to show improvements "as built." Such "as built" plans shall be on suitable reproducible material. Upon receipt of the "as built" plans, the Director of Public Works shall recommend formal acceptance of the improvements by the Council when he is fully satisfied that they have been installed in complete conformance with the provisions of this Chapter and with the "as built" plans. 58. If the applicant does not choose to construct all required improvements prior to recordation of the Final Map, then the applicant shall enter into a Subdivision Improvement Agreement with the City and provide a financial guarantee in the amount and in the form acceptable to the City, prior to recording the Final Map. Completion of the subdivision improvements and submittal and acceptance of the Completion Plans is required prior to the release of the subdivision financial guarantees. 59.The Final Map prepared and submitted for City review and approval shall be consistent with and fulfill the conditions of approval herein and shall comply with the requirements of RCMC Chapter 30 and the Subdivision Map Act. The Final Map shall not be recorded until all the subdivision improvements are constructed or the applicant has entered into a Subdivision Improvement Agreement and provided suitable financial guarantees to ensure the construction of the subdivision improvements. 60.The individual lots may not be sold or conveyed until the Final Map has been recorded. 61. Pursuant to Section 66474.9(b) of the California Government Code, applicant shall defend, indemnify, and hold harmless the City, its agents, officers, and employees from any claim, action, or proceeding against the City or its agents, officers or employees, to attack, set aside, void, or annul the City's approval of Vesting Tentative Parcel Map Application No. TM2008-08, brought within the time period provided for in Section 66499.37.
