8.A. - Page 94 <br /> ATTACHMEN7 1 <br /> RESOLUTIDN NO. � <br /> A RESOLUTIQN OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br /> CITY CERT1FYf NG THE FINA� ENViRONMENTAL IMPACT REPORT <br /> F�R THE FINGER AVENUE NINE-LOT PLANNED DEVELOPMENT <br /> PROJECT; ADOPTING C�QA FINDINGS, AND ADOPTING A <br /> MiTIGATlON MONITORING AND REPORTING P�AN, ALL IN <br /> ACCORDANCE WITH THE REQUIREMENTS OF THE CALIFpRNIA <br /> ENVIRONMENTAL QUALITY ACT <br /> WHEREAS, Kirk McGowan dba McGowan Development {"Applicant"} submitted <br /> applicatiorts #a the City of Redwoad City ("City") far (i) a Planned Develapment Permit, <br /> includir�g Modificatians ta zoning district reguiations, and {ii) a Vesting Tentative Map, <br /> including Exceptions to the Subdivision Ordinance {the "Finger Aven�e Project" or <br /> "Praject"); and <br /> WHEREAS, on Octaber 26, 2009, Redwood City adopt�d a mitigated negative <br /> declaration ("MND") pursuant to the requirements of the California En�ironmental <br /> Quality Act (Public Resources Code section 21000 et seq.; hereafter, "CEQA"}, and its <br /> implementing regulatians (Title 1�, sectians 15000 et seq, of the California Code of <br /> Regula#ions; hereafter, the "CEQA Guidelines"} and approved the Finger A�enue <br /> Project; and <br /> WHEREAS or� November 10, 2009, Friends of Cordilleras Creek and Finger <br /> Avenue Pride Committee (collectively "Friends"} filed a lawsuit with #he San Mateo <br /> County 5uperior Court seeking #a s�t aside the City's adoptian of the MND and <br /> approvals of the Finger A�enue Proj�ct, alleging in the lawsuit�ialations of CEQA; and <br /> WHEREAS, on July 26, 2010, the CEty of Redwood City, McGowan Develapment <br /> and Friends (the "pa�ties") entered inta a Settlement Agreement, whereby the parties <br /> agreed that the City would rescind all o# the appro�als (MND, Planned Development <br /> Permit, and Vesting Tentati�e Map) related to the Finger Avenue Praj�ct; artd <br /> WHEREAS, the Partias alsa agreed to prepare an environmental impact report <br /> ("�IR"} to analyze the related en�iror�mental impacts associated with the 1=inger Avenue <br /> Project; and <br /> WHEREAS, the parties further agreed that the 2008 initial 5tudy associated w�t� <br /> the MND suffici�ntly evafuated the Project's remaining potential impacts and so the EIR <br /> need not evaluate potential impacts other than those listed abo��; and <br /> ATTYIRESQ.226210ERTIFYING EIR FOR FI�IGER AVE <br /> I�EV:07-02-12 VR <br /> Page 1 of 7 <br />
