The City mailed, published and posted on its website a NOP ta notify responsible agencies af the State Office of Planning and Research, all parties to the 5ettfement Agreemerrf and surrounding property owners that an EIR wauld be prepared for the Project in accordance with the stipula#ed judgment of the Superiar Court for #he Caunty of San Matea; and WHEREAS, on July 22, 2��1, City staff issued a Notice of A�ailability to announce the availability of the Draft Focused Environmenta! Impact Report for the �inger Avenue Nine-Lot Planned Develapment Project {"Draft EIR") #or public and responsible agency review and input; and WHEREAS, the Draft EIR was circulated for public review and camment for 45 days beginning on July 22, 2Q11 and ending on September 6, 2011, and was filed with the State Office of Planning & Research under Stat� Clearinghouse No. 20D8112�p0; and WHEREAS, on August 16, 2091, the Planning Commissian he�d a duly noticed public hearing and recei�ed public testimony on the Draft EIR. The Ci#y received a nr�mber af letters and emails from the public during the Draft EIR public reWiew period; and WHEREAS, on August 29, 2011, at a regufarly scheduled Historic Resources Advisory Committee (HRAC) meeting, the HRAC pra�ided input on the Cultural Resaurc�s Section o# the Draft EIR, and adopted a motion finding that the Gultural Resources Chapter af the Draft E�R was complete and adequate for purpases af CEQA. Th� Finai EIR addresses the HRAC input on the Draft EIR; and WHEREAS, pursuant to the requirements of CEQA and the CEQA Guidelines, the City has caused the preparatian of written responses to the comments recei�ed during #he pubfic review and comment periad and included these responses in the First Amendment to the Draft Focused En�ironmental Impact Report for the Finger Avenue Nin�-f�at Planrred De��bpm�nt Project (together with ti�e Draft EIR, the "F�nal EIR"} and prepared a separate document entitled "Mitigation Monitoring and Repo�#ing Program for the �'inger Avenue Project, June 2a12"; and ATTYIR�S0.226210ERTIFYING EIR FOR FINGER AVE REV:07-02-12 VR Page 2 of 7
