8.A. - Page 138 <br /> ATTACHMENT2 <br /> RESO�urroN No. <br /> A R�SOLUTION OF THE CITY C011NCIL OF THE CITY OF <br /> REDWOOD CITY APPROVING A PLANNED DEVELOPMENT <br /> PERMIT PURSUANT T� THE CITY OF REDWOOD CITY <br /> Z�NING ORDINANCE <br /> WHEREAS, Kirk McGowan dba McGowan Development ("Applicant") <br /> submitted applications to the City of Redwood City {"City") for a Planned <br /> Development Permit, includirrg Madifiications to zoning district regulatians, an� a <br /> Vesting Tentative Map includir�g Exceptians ta the Subdivision Ordinance {the <br /> "Finger A�enue Project" or"Project"); and <br /> WHEREAS, the Planning Commission of the City of Redwood City <br /> ("Commission"} is empowered by Article 46 (Planned De�elopm�nt Permits) of <br /> the City of Redwood City Zoning Code to act upan applications for planned <br /> de�elopment permits within single-family residential zoning districts; #he <br /> Commissian is also empowered by the Subdivision Map Act and the Redwood <br /> City Municipal Code to consider Vesting Tentative Map Applications; and <br /> WHEREAS, pursuant to a Settlement Agreement dated July 26, 2010 by <br /> and among Ap�licant, City, and the Friends of Cordilleras Creek and Finger <br /> A�enue Pride Committee {"Friends"}, among other thir�gs, the City agreed to <br /> prepare and cerkify an Environmen#al Impact Report for the Project pursuant to <br /> California Environmental Quality Act ("CEQA") before a�proving the Praject. The <br /> City also agreed that the Pro�ect and Environmental Impact Re�ort s�all be <br /> considered by both #he City's Planning Cammission and City Council; and <br /> WHEREAS, on June 19, 2012, the Planning Commission held a duly <br /> noticed public hearing on the Finger Avenue Project, including the Final <br /> Environmental Impac# Report far the Finger Avenue Nine�Lot Planned <br /> Development Project ("Final EIR"), and recammended that the City Council (1} <br /> certify the EIR, adopt the necessary CEQA Findings, and adopt a Mitigation <br /> Monitorirtg and Reporting Plan in aceordance with CEQA, by Resolu#ion No. �2- <br /> 16 and (2) strangly consid�r approval af the alternative identified in the Final EIR <br /> as the "Project with 25 Foot Creek Setback Alternati�e" without (a) increasing <br /> hame sizes efsewhere in l.ots 1-4, (b) reducing front yard setbacks ar driveway <br /> apron parking, or (c) removing heritage trees ather than thase (1D trees} already <br /> propos�d for removal by the Praject applicant, by Resolutiar� No. �2-�9; and <br /> WHEREAS, the "Project with 2� Foot Creek Setback Alternati�e" is similar <br /> to the Project as praposed by the de�elo�er except that the residences on Lots <br /> 1-4 would be setback 25 feet from the top of creek bank and reduced in size by <br /> 187 square feet for Lot 1, 348 square feet for Lot 2, 95 square feet far Lat 3 and <br /> 87 square feet for �at 4 (for a total building reduction of 720 square feet).
