Such "as buiit" plans shall be or� suitable re�roducible material. Upon receipt af the "as built" plans, the Director o# Public Works shall recommend formal acceptance of the improvements by t�e Council when he is fully satESfied that they have been installed in comp�ete conformance with the provisions of#his Chapter and with the "as built" plans. 57.If the applicant does not choase #a construct all required improvements prior to recordation of the Finaf Map, then the applicant shall enter into a Subdi�ision Improvem�nt Agr�ement with the City and provide a financia! guarantee in the amaunt and in the form acceptabie to the City, prior to recording the Final Map. Completion of the subdivision impro�ements and submittal and acceptance of the Completion Plans is required prior to the release of the subdivision financial guarantees. 58.The Final Map prepared and submitted for City re�iew and appraval shall be consistent with and fulfill the conditior�s of approval herain and shall compiy with the requirements af RCMC Chapter 30 and the 5u�division Map Act. The Final Map shall not be recorded until alf the subdivision improvements are constructed, or the applicant has entered into a Subdivision Impro�emen# Agreement and provided suitable financial guarantees ta ensure the constructian of the subdivision improvements. 59.The individual lots may not be sold or con�eyed until the Final Map has been recorded. 60.Pursuan# to Section �6474.9(b} af the Caiifornia Gavernment Code, applicant shail defend, indemnify, and hold harmless the City, its agents, o�cers, and employees from any claim, action, ar �roceeding against the City or its agents, ofFicers or emplayees, to attack, set aside, void, ar annul the City's appra�af of Vesting Tentative Parcel Map Application No. TM2D08-08, brought withir� the time period provided far in Section 66499.37. The City shall promptly notify Applicant of any such claim, action or proceeding and shall cooperate fully in the defense. Section 4.This Resolution is effective upon its adoptian.
