<br /> 10. CONTRACTOR'S STATUS. In the pe�formance of the obligations set forth in thi5
<br /> agreement, Con#ractnr shall ha�e the status of an independent cnntractor and shall not be deemed to be
<br /> an employee, agent or officer of City.
<br /> 11. H�LD HA�MLESS. Contractor hereby agrees to defend, indemnify and save harmless
<br /> City, its Council, ofFicers, boards, comrnissions, agents and employees {collecti�ely, "fndernnite�s")
<br /> against and from any and all claims, suits or actions of e�ery name, kind and description, damages,
<br /> losses and expenses induding attnrney fess, arising from, or alleged to have arisen from, any act or
<br /> omissian to act, negliger�t or otherwise, of Cantractar, its officers, agents or employees under this
<br /> agreement.
<br /> 12. NON-DISCF21M1NAT10N AN� �QUAL OPPORTLINITY. Contractor hereby warrants and
<br /> agrees thaE, in the performance of this agreement, it will not, in connection with the employment,
<br /> ad�ancement or discharge of employees, or in connection with the terms, conditions or privileges of their
<br /> employment, discriminate against person because of their age, except upon the basis of bana fide
<br /> accupational qualification, retirement plan or stats�tory requirement, and will not specify, in soficitations ar
<br /> ad�ertiserrr�nt for employees to work on this contract, a maximum age limit, unless such limit is based
<br /> upon a bona fide occupational qualification, retirem�nt plan or statutory requirement.
<br /> Cor�tractor further warrants and agrees that it will comply with all pro�isions of executive Order
<br /> 11246 of September 24, 1965, and of the rulss, regulations and rele�ant orders of the Secretary of Labor;
<br /> and that it wil! not discriminate against any employee ar applicant for employment because of race, cofar,
<br /> religion, sex or national origin. Gontraetor will take af#irmati�e action to ensure that appficants are
<br /> employed and that employees are treated during employment, without regard to their race, color, religion,
<br /> sex or national origin. Such action shall include, but no# be limited to, the following: employment,
<br /> upgrading, demotian, or transfer, recruitment or recruitment advertising; layoff ar terminatfon; rates of pay
<br /> or other forms af compensation; and selection for training, including apprenticeship.
