City may audit the records and <br /> accounts of Contractor for the purpose �f verifying �xpendFt�res by Cantractor of <br /> funds provided by City pursuant ta this Agreement or verffying statements ar <br /> analyses made or provided by Contractar under this Agreement. Contractor wil! <br /> promptly respond to, and comply with, any audit exception made or taken by City <br /> ar appropriate federal agencies reiati�g to Contractor's performance ar failure to <br /> perfarm under t�is Agreement. Contractflr will, upon demand !�y City, pay City <br /> the full amount owing to City or to the United States Government as a result of <br /> any such audit exception. <br /> City will manitor Contractor's Praject an� exper�ditures made pursuant to <br /> this Agreement qUarterly ta verify Contractor's campliance with this Agreement <br /> and local and federal contract requirements. Cantractor sha�l cooperate with City <br /> and provide alf documents and information requested by City in a #imely and <br /> accurat� fashion. <br /> 9. RECORD RETENTION. Cantractor shall retain all financial, <br /> sup�orting documents, statistical records, and all other records pertinent to ti�e <br /> Agreement far a period of faur (4} years. The retention period begins on th� date <br /> of the submission af the City's Comprehe�sive Annual Performance & Evafuation <br /> Report (CAPER) to HUD in which the activities assisted under the Agreement are <br /> reparted on for the fir�al tim�. Notwithstanding tl�e above, if th�r� is litigation, <br /> claims, audits, negotiations or other actions that invol�e any ofi the records cited, <br /> and that have started before th� expiration of the four-year period, then such <br /> records must be retained until completian o# #he actions and resolution of alf <br /> issues, or the expiration of t�e four year period, whichever occurs later, <br /> 1 Q.
