<br /> (d) Praviding that Contractor's insurance co�erage will be primary
<br /> insurance with respect ta City, its Council, officers, boards,
<br /> commissions, employe�s, and agents, and any insurance or self-
<br /> insurance maintained by City far itself, its Council, officers, boards,
<br /> commissians, employees, ar agents shall be in excess of
<br /> Contractar's insurance and not contributory with it.
<br /> 16. NON-DISCRIMINATIQN AND EQUAL OPPORTUNiTY, Contractor
<br /> hereby warrants and agrees that, in the performance of this Agreement, it will not,
<br /> in connection with the employment, advancement or discharge of employees, ar
<br /> in connection witi� the terms, conditions ar pr�vileges of their employment,
<br /> discriminate against persan because of their age, except upon the basis of bona
<br /> fide occupational qualificatiorr, retirement plan or stafutory requirement, and will
<br /> not 5pEC1fJ/, in salicitations or advertisement far employees to work on this
<br /> Agreement, a maximum age limit, unless such limit is based upon a bona fide
<br /> occupational qualificatian, retirem�nt plan or statutary requirement.
<br /> Contractor further warrants and agrees that it will comply with all
<br /> provisions of Executive Or�er 11246 of Sept�mber 24, �965, as amended, and of
<br /> the rules, regulations and relevant orders of the Secretary of �.abor; and that it
<br /> wil] nat discriminate against any employee or applican# for employment because
<br /> of race, colar, religion, sex or national arigin. Contractor will take affirmative
<br /> action to �nsure that applicants are employed, ar�d that employees are treated
<br /> during employment, without regard to the�r race, color, religion, sex or national
<br /> origin. Such actior� will include, but not be limited to, the following: employment,
<br /> upgrading, demotion, or transfer, recruitment or recruitment ad�ertising; layaff or
<br /> termination; rates of pay or other forms of compensation; and selectian fvr
<br /> training, including apprenticeship.
