<br /> City shall monitor Contractor's Program and expenditures made pursuant to this agreement semi-
<br /> annually to verify Gantractor's compliance with this agreement and local contract requirements.
<br /> 10. CONTRACTOR'S STATUS. In the performance of the obligations set forth in this
<br /> agreement, Contractor shall ha�e the status of an ir�dependent contractor and shaff nat be deemed to be
<br /> an empfoyee, agent or officer of City.
<br /> 1�. NOLD HARMLESS. Contractor hereby agrees to defend, indemnify and sa�e harmless
<br /> City, its Cauncil, officers, boards, commissions, agents and employees (collectively, "Indemnitees")
<br /> against and from any and all claims, suits or actions of every name, kind and description, damages,
<br /> losses and expenses including attorney fees, arising from, or alleged to hav� arisen from, any act ar
<br /> omission to act, neglig�nt or otherwis�;, of Contractor, its officers, agents or em�loyees under this
<br /> agreement.
<br /> �2. NON-D�SC�IMINA7fON AN� EQUAL OPPORTUNITY. Contractor hereby warrants and
<br /> agrees that, in the performance of this agreem�nt, it will not, iR connection with the employmer�t,
<br /> ad�ancement or discharge of empfoyees, or in connectian with the ter�ns, canditions or privileges of their

<br /> 11246 of September 24, 1965, and of the rules, regulations and rele�ant orders of the S�cretary of Labor;
