Contractor hereby agrees to defend, indemnify <br /> and save harml�ss City, its Council, ofFicers, boards, commissions, agents and <br /> emplayees (collectively, "lndemnitees"} against and from any a�d all claims, suits <br /> or actians of every name, kind and descrEption, which may be brought against <br /> Indemnitees, or any of them, by reason of any injury to, or deatl� af, any person <br /> (includir�g corporations, partnerships and assaciation} or damage suffered ar <br /> sustained by any such person ar property damage (including loss of use thereo� <br /> arising from, or alleged to have arisen from, any act ar amission to ac#, negligent <br /> or otherwise, of Contractor, its office�s, agents or employ�es under this <br /> Agre�ment. <br /> The duty of Contractor to defend, indemnify and save harmless, as set <br /> farth herein, wil� include the duty to defend as set farth in Section 2778 of the <br /> Califarnia Ci�il Code; provided, haweuer, that nothing herein will be car�strued to <br /> require Contractor to indemnify Indemnitees against any responsibility or liability <br /> in contra�ention of Sec#ion 2782 of the California Civi! Code. This Paragraph 14 <br /> shall survive the terminatior� of this Agreement. <br /> 15. INSURANCE.
