<br /> 14. CONTRACTQR'S STATUS. In the performance of the obligations set forth in this
<br /> agreement, Contractor shall have the status of an independent cantrac#or and shall not be deemed to be
<br /> an employee, agent or officer of City.
<br /> 11. HO�.D HARMLESS. Contractor hereby agrees to defend, indemnify an� sa�e harmless
<br /> City, its Council, officers, boards, commissians, agents and employees (collectively, "Indemnitees")
<br /> against and from any and all claims, suits or actions of every name, kind and description, damages,
<br /> losses and expenses including attorney fees, arising from, or alleged to have arisen from, any act or
<br /> omission to act, negligent or otherwise, of Contractor, its officers, agents or employees under this
<br /> agreement.
<br /> 12. NO[�-D15CR�Ml�fA710N AN� EQUAL OPPORTUNlTY. Contractor hereby warrants and
<br /> agrees that, in the pertormance of this agreement, it will not, in connection with the errrplayment,
<br /> advancement or discharge of employees, or in cannection with the terms, conditions or privil�ges of their
<br /> employment, discriminate against person becausa of their age, except upon the basis of bona fide
<br /> occupational qualification, retirement p�an or statutary requir�ment, and will not specify, in solicitations or
<br /> ad�ertisement for employees to work on this contract, a maximum age limit, unless such limit is based
<br /> upon a bona fide occupatianal qualification, retirement plan or statutory requirement.
<br /> Cor�tractor further warrants and agrees that it will comply witt� afl pro�isions of executive Order
<br /> �1246 af September 24, 1965, and of the rules, regulatians and rele�ant orders of the 5ecretary of Labor;
<br /> and that it will not discriminate agains# any employee or applicant for emplayment because of race, color,
<br /> religian, sex or national origin. Contractor will take affirmative action to ensure that applicants are
<br /> employed and that employees are treated during employm�nt, without regard to their race, color, feligion,
<br /> sex or nationa� origin. 5uch action shall include, but not be limited to, the following: employment,
<br /> upgrading, demotion, or transf�r, recruitment ar recruitment ad�ertising; layoft or termination; rates of pay
<br /> or other forms af com�ensatian; and selection for training, including apprenticeship.
