6.1.1. - Page 2 Valentine Corp.- San Rafael $331,800.00 Cal—Pacific Construction Inc. — Fremont $537,941.50 Engineer's Estimate $305,000.00 The second lowest bidder, Applied Water Resources Corporation, protested the lowest base bid of $274,052.49 submitted by lonian Construction, Inc. Applied Resources alleged that lonian Construction did not have the minimum required experience to be considered a responsible bidder for this project as stipulated in the city's contract documents. The Instructions to Bidders for this project states: Minimum experience requirements of the prime contractor including the completion of 3 projects of similar nature and complexity involved with contract dollar amounts of at least $300,000 each, within the past 5 years. Staff requested lonian provide verification of its qualifications meeting the Instructions to Bidders. lonian's response did not demonstrate that it met the minimum experience requirements of the bid documents. The list of projects lonian submitted to the City did not include any projects of a nature or complexity of this project. The second low bidder, Applied Water Resources Corporation has the experience and qualifications to perform this type of work, and staff recommends awarding this contract to Applied Water Resources Corporation. Their bid of $275,670 is 7.9% lower that than the engineer's estimate of $305,000. Staff believes that the low bid is reasonable and recommends awarding the contract to Applied Water Resources Corporation. ALTERNATIVES Council may choose to reject all bids and direct staff to consider other methods of maintaining the widgeon grass in the lagoons in Redwood Shores. FISCAL IMPACT Funds for the proposed maintenance boat ramp were previously approved and appropriated as GID 1-64 Facilities Charge Construction — Lagoon Maintenance Boat Ramp which has an available balance of $321,616, augmented by the Capital Projects Fund— Storm Drain Creeks & Channels which has an available balance $887,202.01. ENVIRONMENTAL REVIEW The project is Categorically Exempt under Section 15304 - Minor Alterations to Land. Redwood Shores lagoons are a man-made lagoon system and the water level is controlled by the city and is not subject to tidal conditions. All surrounding landscaping will be restored after completion of the project. The Corps of Engineers has approved Permit No. 2010-00301 S for this project
