8.A. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> October 8, 2012 <br /> SUBJECT <br /> Proposed City Council Policy Regarding City Real Property Acquisition and Disposition <br /> RECOMMENDATION <br /> Review Proposed Policy Regarding City Real Property Acquisition and Disposition <br /> and Direct Staff To Return Policy With Any Revisions For Adoption At Future Meeting. <br /> BACKGROUND <br /> Until 2011, the City's procedure for disposing of property was limited to selling to the <br /> highest bidder. In 2011, the City Charter was amended to make the City's procedures <br /> for acquiring and disposing of property similar to general law cities. Section 3-1/2 of the <br /> City's Charter now provides: <br /> Subject to any additional provisions that the City Council may enact by <br /> ordinance, the City may purchase, /ease, receive, hold and enjoy real and <br /> personal property, and control and dispose of it for the common benefit. <br /> The Charter as amended provides the City with greater flexibility in managing its assets <br /> and at the same time recognizes the need for implementing policies and procedures <br /> that will provide guidance to staff and to the community. <br /> The first step toward implementation occurred in early 2012 when the City conducted a <br /> comprehensive inventory of City-owned property and then also conducted a facilitated <br /> evaluation of land disposition under the 2010 General Plan, the revised 2011 <br /> Downtown Precise Plan, and current market conditions. (See April 23, 2012 Report <br /> Regarding Inventory of City-Owned Parcels.] <br /> The next step is to consider a policy that sets forth responsibilities, general strategies, <br /> and procedures for the acquisition and disposal of real property and provides a <br /> framework that assures that any such action advances the City plans, policies, and <br /> goals, as well as provides for effective stewardship of City assets. <br /> Once the policy has been reviewed and approved, some revisions to the Municipal <br /> Code may be necessary to ensure consistency between these procedures and the <br /> Code. This policy will also need to be updated from time to time to account for changing <br /> market conditions. <br />
