NON-PROFIT LEASES, SHORT-TERM LICENSES AND DISPOSAL OF
CITY RIGHT-OF-WAYS
The following guidelines apply to leases of City-owned properties to non-profits, licenses of
City-owned properties for short term interim uses, and dispositions of City right-of-ways. Staff
should consult with the City Attorney's Department prior to engaging in negotiations to
determine whether a lease or license is appropriate for an interim use.
1. Leases or Licenses with Non-Profit Organizations.
• Requests for the long-term use of City property by non-profit
organizations should generally follow the same review procedures as
the sale or lease of City property by private for-profit entities.
• The proposed use should not conflict with or preclude any existing or
planned future City use.
• Any development or operations directly related to the proposed use
should have a clear and measurable community benefit in alignment
with City goals, policies and plans.
• Any agreements for the lease of City property by non-profit
organizations at a below-market rate rent should include a provision
for community access and/or City use, or operate in close partnership
in the delivery of City services.
• Lessees will be responsible for all possessory interest and property
related use taxes that may be assessed.
• Lease agreements should include a waiver of any rights to relocation
benefits.
• Lessees must comply with non-discrimination requirements.
ATTY/POLICIES/PROPERTY ACQUISITION AND DISPOSITION PROCEDURES
REV:10-04-12 PT
