8.A. - Page 25 <br /> 2. Interim Uses. <br /> The Council will determine appropriate interim uses of City-owned property on a case-by-case <br /> basis. The Council may wish to establish additional procedures by ordinance so that interim <br /> uses may be authorized by the City Manager or the Community Development Director. <br /> Lessees/licensees will pay comparable market rents, provided, however, below-market rates <br /> may be considered for non-profit organizations in accordance with the guidelines above. <br /> • Unless otherwise agreed upon, lessees/licensees will be responsible for making <br /> any tenant improvements, if any, and complying with all City zoning and land use <br /> requirements, including any special conditions the City may place on the <br /> property or particular noticing requirements that the City may enact. <br /> • Environmental analysis is still required for interim uses. <br /> 3. Right-of-Way. <br /> Right-of-way (ROW) disposals may be initiated by the City or in response to public requests. <br /> Right-of way will only be abandoned when it has no apparent City current or future use. The <br /> following guidelines shall apply to the disposal of public ROW: <br /> a) The City will follow requirements of the State of California Streets <br /> and Highways Code in disposing and abandoning public right-of- <br /> way. <br /> b) Right-of-way that has been purchased in fee or easements <br /> purchased with City funds will be sold or leased in accordance <br /> with the policies above. <br /> c) The City may reserve an easement for its water and sewer system <br /> or may reserve a blanket easement for all utilities. Easements <br /> used for utility transmission and distribution systems will normally <br /> be reserved. If the utility previously using the easement declines <br /> further use, the City will offer it to other utilities before <br /> abandonment. <br /> d) The City may place conditions of approval on abandonments of <br /> right-of-way that must be satisfied prior to transfer of ownership <br /> of the subject property or termination of the easement. <br /> ATTY/POLICIES/PROPERTY ACQUISITION AND DISPOSITION PROCEDURES <br /> REV:10-04-12 PT <br /> Page 20 of 21 <br />
