Additional Provisions. Cansultant will ensure that the poiicies of ir�surance required under this Agreement contain, or are endorsed to contain, the faliowing pro�isions: 9 9.2.1 For Cammercial General Liability Insurance and A�tomobiie Liability Insurance: City, ifs officers, agents, va�unteers and employees wiEl be namec! as additional ins�reds. 3'l.2.2 Consultant will obtain occurrence coveTage, except that Professional Liability will be written as claims-made coverage. 11.2.3 This insurance will �e in force during the life of the Agreement and any extensions of it and wil� not be cancelec! without thirty (30) days prior writter� notice to City sent pursuant to the Notice provisi�ns of t�is Agreement, 11.3 Providing Certificates of Insurance and Endorsements. Prior to City's exacution of this Agreement, Consultant will furnish certificates of insurance and endorsements to City. 7'!.4 Faiiure to Maintain Co�eraqe. If Consultant faifs to maintain any of these insurance cnverages, then City will have the option to declare ConsUltant in breach, or may purchase replacement insurance or pay th� premiums that are due on existing p�licies in order to maintain the required cov�rages. Cansultant is responsible for any payments made by City to obtain or maintain insurance and City may co�lect these payments from Consultant or deduct the amount paid from any s�ms due Consultant under this Agreement_ 11.5 Submission of Insurance Policies. City reserves the right to require, at anytime, complete and certified copies of any or all required insurance policies and endorsements Insurance palicies contain confidential proprie#ary information of Consultant and in tF�e e�ent that City requires Consultant to pravide copies of its insurance policies pursuant to this Secti�n, City agrees to pro�ide Consultant with written no#ice prior to releasing copies of such �oficies in response to any Public Records Request or Subpnena, to enable Cansultant to apply for a protecti�e order.
