TO AGREEMENT FOR DEMOLITION, UTILITY RELOCATION, AND <br /> REIMBURSEMENT FOR UNDERGROUND PUBLIC PARKING GARAGE <br />This Amendment No.1 is entered into and effective as of the _~day of <br />~-t~ , 2003, amending the Agreement dated August 21, 2003, (the <br />"Agreement") by and between the Redwood City Redevelopment Agency, a public body, <br />corporate and politic ("Agency"), the City of Redwood City, a charter city and municipal <br />corporation ("City"), and BHV Innisfree Ventures I, LLC, a California limited liability <br />company, in which Cinema Square, LLC, a California limited liability company and Blake <br />Hunt Ventures I, LLC, a California limited liability company, are the sole members <br />("Developer") (collectively, the "Parties") for the demolition, utility relocation and <br />reimbursement for an underground public parking garage. <br /> <br /> RECITALS <br /> <br /> A. Pursuant to the Agreement, the Developer is proceeding with demolition, <br />utility relocation and other activities (defined in the Agreement as the WVork") related to <br />the construction of an underground parking garage; and <br /> <br /> B. It has been determined by the Parties that the scope of the Work must now <br />be expanded to ensure the timely completion of the "Public Parking Facility," as that <br />term is defined in the Agreement; and <br /> <br /> C. The Parties have negotiated and agreed to a supplemental scope of work and <br />fee schedule for this Amendment, which is attached to and incorporated by this <br />reference as Exhibit "A," Scope of Services and Fee. <br /> <br /> NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br />contained herein, the Parties agree as follows: <br /> <br /> 1. In addition to the Work described in the Agreement, Developer will provide <br />those services described in Exhibit "A." <br /> <br /> 2. Developer will be paid, for all work associated with those services <br />described in Exhibit "A," one hundred fifty thousand dollars ($150,000). <br /> <br /> 3. Developer will complete all work described in Exhibit "A" on or before <br />December 1,2003. <br /> <br /> 4. All other provisions of the Agreement will remain in full force and effect. <br /> <br /> 5.
