The builder's risk insurance shall cover all risks of loss, including but not limited to fire; lightning; windstorm; hail, mold occasioned by construction defect, explosion; riot; riot attending a strike; civil commotion; smoke damage; damage by vehicles; vandalism and malicious mischief; theft; collapse; flood; and earthquake, and shall be in a form acceptable to City's Risk Manager. This insurance shall name the City and Agency, as their interests may appear, and shall include coverage including, but not limited to all damages or loss to the work; to appurtenances; to materials and equipment to be used on the Project while the same are in transit or stored on or off the project site; and/or to construction plant and temporary structures. The Builder's Risk insurer shall waive all rights of subrogation against City and Agency. Builder's Risk Insurance may have a deductible clause not to exceed $100,000 for all perils other than earthquake and flood. The Builder's Risk policy shall provide City and Agency the right to occupy the Public Parking Facility premises without termination of the policy until acceptance of the Project. C.
