EXHIBIT A TO CONSTRUCTION AND REIMBURSEMENT AGREEMENT FOR THE DOWNTOWN PUBLIC PARKING FACILITY CITY OF REDWOOD CITY SCOPE OF WORK Developer shall perform the following Services in accordance with the Construction and Reimbursement Agreement for the Downtown Public Parking Facility. Approval of Construction Documents. A. All design documents and construction contracts shall be submitted to the City and Agency for review and approval in accordance with the Schedule of Performance attached as Attachment 4 to the DDA, and shall be in accordance with the City's revised specifications entitled "Engineering Standards of the City of Redwood City," adopted January 5, 1998 which standards are on file in the office of the Manager, Engineering and Construction Department. The Public Parking Facility shall also be constructed in strict compliance with the provisions of Article VII, Chapter 29 of the Code of the City of Redwood City. If any conflict exists between the construction documents and said Chapter 29 in regard to the standard for a particular improvement, the stricter standard shall govern. B. Developer shall use commercially reasonable efforts to cause all of the Work to be completed in accordance with the Schedule of Performance, subject to such exceptions and time extensions allowable under Section 3 below; C. Developer shall have all construction documents for the Public Parking Facility processed through to all agencies with jurisdiction prior to commencement of construction. 2. Award of Contracts for Construction. A. Developer shall obtain at least three (3) competitive bids for each construction trade or discipline involved in construction of the Public Parking Facility in general conformance with the City of Redwood City's procurement requirements, or, if Developer cannot obtain three bids after diligent efforts to do so, Developer shall otherwise satisfy City and Agency that the price for a particular trade or discipline is fair and reasonable. Developer shall provide City and Agency with copies of any and all bids promptly upon written request. B. As provided in Attachment 8 of the DDA, the Parking Facility Cost will be based on the lowest responsive, responsible bids received. If Developer, City and Agency wish to accept a bid other than the lowest responsive, responsible bid for any part of the Public Parking Facility, Developer shall be responsible for identifying cost savings acceptable to the City and Agency to offset the costs: Atty/Agr/Agr.147 101403 Final L.
