C. Upon receipt of bids for the construction of the Public Parking Facility, the <br />total value of the lowest responsive, responsible bids will be compared with the Not-to- <br />Exceed Parking Facility Cost. If the total of these bids causes the Parking Facility Cost <br />to exceeds the amount set forth in Paragraph 3(A) of the Agreement, Developer shall <br />immediately notify the City and Agency. Developer, City and Agency shall meet and <br />confer to address the issue. Developer shall have its Consultants and Contractors <br />propose adjustments to the cost or scope of the Public Parking Facility to bring the cost <br />of construction within the Not-to-Exceed Parking Facility Cost. Developer shall <br />implement such cost reductions as are acceptable to City and Agency. Developer will <br />not award any contract for construction of the Public Parking Facility until Developer, <br />City and Agency have reached a final, documented agreement on each party's <br />responsibility for the cost of construction. <br />D. Developer shall notify City and Agency in writing of the name of each <br />Contractor with whom it enters into a contract in connection with construction of the <br />Public Parking Facility, and shall provide City and Agency with copies of those <br />agreements, and any modifications, upon written request. <br />3. Construction Project Administration <br />A. General Requirements <br />i) Developer shall establish and implement appropriate administrative and <br />financial controls for the design and construction of the Public Parking Facility. <br />ii) Developer shall coordinate and administer performance of the architect, the <br />general contractor, and other Contractors, professionals and Consultants employed by <br />Developer in connection with the design or construction of the Public Parking Facility. <br />iii) Developer shall provide and maintain a management team on the Project <br />site to provide contract administration and shall establish and implement coordination <br />and communication procedures. Developer shall be the party to whom requests for <br />information, submittals, Contractor requests for schedule adjustments, substitutes, <br />change order requests and payment applications shall be submitted. <br />iv) Developer shall not commence construction of the Work on the Project <br />Site until advised by City and Agency in writing that it may do so. <br />v) Developer shall establish and implement procedures for expediting and <br />processing requests for information, shop drawings, material and equipment sample <br />submittals, contract schedule adjustments, change orders, substitutes and payment <br />requests and shall maintain project records and logs current and in good order. <br />B. Schedules and Reports <br />i) Developer shall prepare and distribute to City and Agency a critical path <br />schedule for construction of the entire Project before issuing a Notice to Proceed on the <br />Project.
