viii) The Developer shall prepare and distribute monthly progress payment <br />reports. These reports shall state the total of the Parking Facility Costs, the value of all <br />contracts for construction of the Public Parking Facility, payments made by Developer to <br />date for Parking Facility Costs, current payments requested by Contractors and <br />Consultants, any requests for distribution of the Contingency Funds, retainage held on <br />each contract, and actual amounts Developer proposes to pay to Contractors and <br />Consultants in the current payment period. This report shall include a Certificate of <br />Payment that shall be signed by the Developer and delivered to the City and Agency for <br />use in making reimbursements to the Developer. <br />ix) Developer shall periodically prepare and distribute Change Order Reports <br />during the Construction Phase, beginning after the first change order is approved. The <br />report shall list all approved change orders by number, a brief description of the change <br />order work, a proposed assignment of responsibility for the cost of the change order, the <br />cost established in the change order and percent of completion of the change order <br />work. <br />C. Construction Administration <br />i) Before allowing any Contractor to begin work, Developer shall verify that <br />the Contractor has secured the required building permits, bonds, insurance, labor <br />affidavits and waivers. <br />ii) Developer shall provide all testing and inspection services required for the <br />Project through appropriate Consultants acceptable to City and Agency. <br />iii) Developer shall provide all of the construction administration services <br />typically performed by the design professional (including but not limited to interpretation <br />of the Construction Documents, reviewing and taking appropriate action on Contractor <br />submittals, response to contractor requests for information, and assessment of <br />proposed material or equipment substitutions) through appropriate Consultants <br />acceptable to City and Agency. <br />iv) Developer shall coordinate all technical inspection and testing required for <br />the Project. Developer shall be provided a copy of all inspection and testing reports on <br />the date of the inspection or test. <br />v) Developer shall review proposed substitutions for specified products or <br />equipment for the Public Parking Facility with the design consultants and shall prepare <br />and present recommendations to the City and Agency on acceptance of the proposed <br />substitution in report form. Developer shall not allow the contractors to make any <br />substitutions that will affect the Public Parking Facility without written approval from the <br />City and Agency. <br />vi) Developer shall review the contents of requests for changes to the <br />contract time or price submitted by a Contractor, assemble information concerning the <br />AttylAgdAgr.147 <br />101403 Final <br />L.
