viii) The Developer shall prepare and distribute monthly progress payment reports. These reports shall state the total of the Parking Facility Costs, the value of all contracts for construction of the Public Parking Facility, payments made by Developer to date for Parking Facility Costs, current payments requested by Contractors and Consultants, any requests for distribution of the Contingency Funds, retainage held on each contract, and actual amounts Developer proposes to pay to Contractors and Consultants in the current payment period. This report shall include a Certificate of Payment that shall be signed by the Developer and delivered to the City and Agency for use in making reimbursements to the Developer. ix) Developer shall periodically prepare and distribute Change Order Reports during the Construction Phase, beginning after the first change order is approved. The report shall list all approved change orders by number, a brief description of the change order work, a proposed assignment of responsibility for the cost of the change order, the cost established in the change order and percent of completion of the change order work. C. Construction Administration i) Before allowing any Contractor to begin work, Developer shall verify that the Contractor has secured the required building permits, bonds, insurance, labor affidavits and waivers. ii) Developer shall provide all testing and inspection services required for the Project through appropriate Consultants acceptable to City and Agency. iii) Developer shall provide all of the construction administration services typically performed by the design professional (including but not limited to interpretation of the Construction Documents, reviewing and taking appropriate action on Contractor submittals, response to contractor requests for information, and assessment of proposed material or equipment substitutions) through appropriate Consultants acceptable to City and Agency. iv) Developer shall coordinate all technical inspection and testing required for the Project. Developer shall be provided a copy of all inspection and testing reports on the date of the inspection or test. v) Developer shall review proposed substitutions for specified products or equipment for the Public Parking Facility with the design consultants and shall prepare and present recommendations to the City and Agency on acceptance of the proposed substitution in report form. Developer shall not allow the contractors to make any substitutions that will affect the Public Parking Facility without written approval from the City and Agency. vi) Developer shall review the contents of requests for changes to the contract time or price submitted by a Contractor, assemble information concerning the AttylAgdAgr.147 101403 Final L.
