request and endeavor to determine the cause of the requests. If Developer believes <br />that the requested change may affect the Project schedule and/or require the City and <br />Agency to increase their financial contributions to the Project, Developer shall prepare <br />and submit to the City and Agency a written analysis of the proposed change and a <br />recommendation with respect to acceptance of the request. <br />vii) Developer shall review the payment applications submitted by each <br />Contractor and Consultant and determine whether the amount requested reflects the <br />progress of the Contractor's or Consultant's work. Developer shall make appropriate <br />adjustments to each payment application and shall prepare and forward to the City and <br />Agency a progress payment report. The report shall state the total contract price, <br />payments to date, current payment requested, retainage and actual amounts owed for <br />the current period. Included in this report shall be a Certificate of Payment that shall be <br />signed by the Developer and delivered to the City and the Agency. <br />viii) Developer shall establish and implement a program to monitor the quality <br />of the construction, and shall inspect the progress of the course of construction of the <br />Public Parking Facility, and verify that the construction is being carried out substantially <br />in accordance with the Construction Documents. The purpose of the program shall be <br />to assist in guarding against defects and deficiency in the work of the Contractor. <br />Developer is not authorized as a part of this service to change, revoke, alter, enlarge, <br />relax or release any requirements of the Contract Documents or to approve or accept <br />any work not performed in accordance with the Contract Documents. Communication <br />between the Developer and Contractor with regard to Quality Review shall not in any <br />way be construed as binding the City and Agency as releasing the Developer or <br />Contractor from the fulfillment of any of the terms of his Contract Documents. <br />D. Completion of the Project <br />i) Developer shall advise the City and Agency when he believes the Public <br />Parking Facility is substantially complete. Before City and Agency issue a Certificate of <br />Substantial Completion, Developer, City and Agency shall prepare a list of incomplete <br />work which does not conform to the Contract Documents. This list shall be attached to <br />the Certificate of Substantial Completion. <br />ii) Developer shall advise the City and Agency when he believes the Public <br />Parking Facility is finally completed, and shall provide to the City and Agency a written <br />recommendation regarding acceptance of the Public Parking Facility. City and Agency <br />will issue a Certificate of Completion when they determine that the Public Parking <br />Facility is complete. <br />iii) Developer shall make recommendations to the City and Agency <br />concerning filing of any notices of completion required or permitted to be filed upon the <br />completion of the Project and taking such actions as may be required to obtain any <br />certificates of occupancy or equivalent documents required to permit the occupancy of <br />any improvements.
