B. - Page 24 • The proposed use should not conflict with or preclude any existing or planned future City use. � Any development or operations directly related to the proposed use should have a clear and measurable community benefit in alignment with City goals, policies and plans. • Any agreements for the lease of City property by non-profit organizations at a below-market rate rent should include a provision for community access and/or City use, or operate in close partnership in the delivery of City services. � Lessees will be responsible for all possessory interest and property related use taxes that may be assessed. • Lease agreements should include a waiver of any rights to relocation benefits. • Lessees must comply with non-discrimination requirements. 2. Interim Uses. The Council will determine appropriate interim uses of City-owned property on a case-by-case basis. The Council may wish to establish additional procedures by ordinance so that interim uses may be authorized by the City Manager or the Community Development Director. Lessees/licensees will pay comparable market rents, provided, however, below-market rates may be considered for non-profit organizations in accordance with the guidelines above. � Unless otherwise agreed upon, lessees/licensees will be responsible for making any tenant improvements, if any, and complying with all City zoning and land use requirements, including any special conditions the City may place on the property or particular noticing requirements that the City may enact. � Environmental analysis is still required for interim uses. 3. Right-of-Way. Right-of-way (ROW) disposals may be initiated by the City or in response to public requests. Right-of way will only be abandoned when it has no apparent City current or future use.
