Owner is the owner of that certain real property located at 150 El Camino Real (APN 052- <br />064-100) in Redwood City, CA which is more particularly described on Exhibit "A" attached <br />hereto and incorporated herein by this reference ("Parcel 1") and that certain real property located <br />at 20 Avondale (APN 052-064-110) in Redwood City, California, which real property is more <br />particularly described on Exhibit "B" attached hereto and incorporated herein by this reference <br />("Parcel 2"). Parcel 1 and Parcel 2 are adjacent pi-operties and shall be collectively referenced as <br />the "Parcels". <br /> <br /> B. In connection with the development of the Parcels, Owner has established a general plan for <br />the improvement of the Parcels and does hereby establish restrictions and covenants to which the <br />Parcels shall be subject as more particularly described herein and each of which are for the benefit <br />of the owner of any of the Parcels and shall apply to and bind the respective successors in interest of <br />the owner or owners thereof and there is hereby imposed upon the Parcels the restrictions contained <br />herein as a servitude in favor of each of the Parcels as a dominant tenant. <br /> <br /> DECLARATION AND COVENANTS <br /> <br /> NOW, THEREFORE, the undersigned hereby declares and covenants that the Parcels shall be <br /> subject to the following: <br /> <br /> 1. Parcel 2 shall be restricted such that no permanent structure may be constructed on the <br /> surface of Parcel 2; provided, however, "permanent structure" shall not include such <br /> improvements as are necessary for pedestrian and vehicular ingress and egress to a <br /> subterranean garage to be constructed on and below the surface of the Parcels, nor shall <br /> "permanent structure" include any drainage facility, fence, garbage enclosure, <br /> landscaping, paving, curb, wall, sign, artwork, fountain, light fixture or pole. <br /> <br /> 8/15/2003 1 <br /> <br /> <br />
