DES:df~ ~/23/9~ (007/62) <br /> <br /> FIRST AMENDMENT TO <br /> UNIFORM FRANCHISE AGREEMENT <br /> <br /> This FIRST AMENDMENT to the UNIFORM FRANCHISE AGREEMENT of <br />October 1, 1987, (the "Uniform Franchise Agreement") is made by <br />and between the CITY OF REDWOOD CITY, a municipal corporation of <br /> <br />the State of California ("Agency"), and BROWNING-FERRIS <br /> <br />INDUSTRIES OF CALIFORNIA, INC. ("BFI"); <br /> WITNESSETH: <br /> <br /> WHEREAS, BFI has agreed to develop a recyclable processing <br />facility to divert from sanitary landfill some thirty percent <br />(30%) of the solid wastes collected from the jurisdictions of the <br />member agencies of the South Bayside Transfer Station Authority <br />("Authority"), of which City is a member; and <br /> <br /> WHEREAS, BFI has committed itself to develop, permit and <br />operate a "Green Waste" facility that will divert from sanitary <br />landfill an additional twenty percent (20%) of the Authority's <br />member agencies' waste; and <br /> <br /> WHEREAS, said diversion will implement Agency's requirements <br /> <br />to reduce disposing of solid wastes in landfills; and <br /> <br /> WHEREAS, BFI has requested, and the Agency has agreed, to <br />amend the UNIFORM FRANCHISE AGREEMENT in exchange for the <br /> <br />development and operation of the aforesaid facilities: <br /> NOW, THEREFORE, BE IT AGREED AS FOLLOWS: <br /> <br /> 1. Section 2.2 Term, subsection (b) of the UNIFORM <br />FRANCHISE AGREEMENT is amended to provide that the initial term <br />of the UNIFORM FRANCHISE AGREEMENT shall expire on September 30, <br />1999, unless extended as provided herein. <br /> <br /> <br />
