amount of such insurance shall be as follows: <br /> <br /> (1) In an amount not less than $500,000 for <br /> injuries, including, but not limited to, <br /> accidental death to any one person, and <br /> subject to the same limit for each person <br /> in an amount not less than $1,000,000 on <br /> account of one accident or occurrence; <br /> <br /> (2) Property damage in an amount not less than <br /> $500,000 arising from any one occurrence; <br /> <br /> Each of said insurance policies shall be subject to <br /> approval by the City Attorney of City. Certificates <br /> evidencing the required insurance coverages shall be <br /> filed with the City Clerk of City and be maintained <br /> in force during the ~life of this agreement. <br /> <br /> (c) Notwithstanding any of the above, Company's Public <br /> Liability insurance may provide for self-insured <br /> retention of $300,000, with the effect that Company <br /> is the insurer to such extent; and that the insurance <br /> required to be maintained may be provided by a blanket <br /> insurance policy maintained by Company's parent cor- <br /> poration, Browning-Ferris Industries, Inc. In the <br /> event such self-insurance retention is elected, <br /> Company shall defend and hold City harmless as <br /> otherwise provided hereinabove. <br /> <br /> 17. Disposal. Company shall take all garbage or refuse <br />collected for disposal beyond the City limits of City, and all <br />such garbage or refuse so collected shall be the sole property <br />of Company. Company may retain kitchen refuse or other matter <br />suitable for feeding to domestic animals and feed same to said <br />animals or may use same for fertilizer, providing the use of <br />such matter in such a manner meets with the approval of the Health <br />Officer of City or of such other officer having jurisdiction of <br />the matter. Company may also salvage such material as may be <br />recycled for reuse, such as paper, wood, glass, metals and <br />appliances. <br /> <br /> 18. Negotiations for New Rates. (a) The rates specified <br />by agreement between Company and City have been established after <br />consideration of Company's rate of return on investment and of <br />all operating costs, interest payments, corporate taxes and a <br />reasonable return as profit to Company commensurate with the <br />Operating Ratio Method employed by the Public Utilities <br />Commission of the State of California and the Interstate <br /> <br /> -7- <br /> <br /> <br />
